My new Service Officer (new one here in Oregon) says I need to file for TDIU, even though I am stuck at 60% until the appeals go through, meanwhile she says I need to file, and I told here I tried to get my last Service Office (American Legion) San Diego, refused saying I didn't qualify at 60%. I told the original Service officer that although the books say 60% to file TDIU, that is only a guideline. The new Service Officer wrote up the Papers immediately. I was pissed and still pissed when the last S.O. refused and I lost all the time. But at least it's being filed. When she said do it, I said yes, please send it in!

I know no one can possibly now any outcome in advance but I have way more than enough to wins more claims anyways. But, no one can see the future of what will happen. She still has to get the C-File, even though I told her I have copies of everything she is ordering here own copies. My case is huge amount of documents and medical issues, but hope she will be able to grasp everything, since it's so screwed up. I can tell you when I go to office here, there are not many people in line.

Another thing, is the medical is to crowded here in Oregon. Also, having to go to Portland sucks, they just don't have many places to get the specialized treatments and tests. There are long waits to get a doctor close to me, my primary care is at least one hour away. I do use the DAV for rides, when I can.

Travel was confusing, even though I have had direct deposit from the VA for many years, the travel office sent me a check when I turned in mileage. I sent a new authorization in even though I am already on Direct Deposit for my VA disability checks. We have had the same national bank for 20 years. Maybe when you move they make you go through reauthorization? I have only turned in form, the waits for the Portland travel office are crazy long with people in very long lines. I just can't sit in lines for hours. For something so simple. First time was primary care, second time was emergency x-rays for a bad fall.

Not in appeals, since I got 100%, and some of it was winning an 1151 negligence, which the VA turns out does not give ful benefits if you win 1151 negligence they squirm and legal loophhole you and your family out of many benefits, really crapp nasty bunch running the va benefits, they wil backstab and scre wyou even if you win you lose. May 2021.

retiredat44 - during my appeal I filed for TDIU, no less than 4 times, and I started filing at the 30% ratings level. I eventually won TDIU in two decisions but kept appealing and won 100% back to my original filing date. Too bad your AL VSO was so worthless and you lost that time!!!!!!!!!

hell I thought it was 70 percent for tdui? I have 40 and 30, and, 0 , and 0. + 60 can I file,? Im currently unable to work, and have filed for ss. I have a lawyer. waiting on my court date for ss judge.

I have been through the SSD and finally got it, but not before losing a few dozen retro 'thousands' when the first case tanked at the ALJ level. I happened to get a judge who was so devastatingly unpopular due to his 60-something percental 'disapproval' rating for SSD claimants, apparently no lawyer around town would take the case on my behalf; so I ended up going to one of the terrible 'drive-through' national firms who hardly know your name let alone your medical disabilities.

Beware of any social security lawyer advertising that says things like 'will fight for you' - I talked personally to one of those 'TV lawyers' and he said emphatically "I only take cases I know I will win." I guess it is easy to fight in that case.

You do your research and ask yourself those honest questions which you have to find for yourself, I can't tell you what they are. You will get there but please be BRUTALLY HONEST about your symptoms and how they affect your daily life and activities of daily living.

Steve, I hope with all my heart that your new VSO reads that SOC or SSOC you got, in which the VA admitted to negligence.

I discussed that before with you here many times , and you did say you filed the 1151 claim...not the one I prepared for you, but one you sent before I could even post what I wrote.......the claim I prepared for you is still here someone on the board....so no use kicking that mule again.

Sure .........you should be TDIU or 100%..........Absolutely...........under Section 1151,.38 USC.

Even one of your doctors agreed with my point last year. VA buggered you up but good and admitted to it in one of their SOCs or SSOC you got.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
