Question

After 2 years the Chicago RO denied my claim for multiple sclerosis. I had the medical nexus,buddie letters,solid medical evidence and a written time line of events. my claim was in Chicago since June 2011and around feb. 2013 they outsourced my claim to the Des. Moines Iowa RO. And within a couple of weeks my claim started to move but in the wrong direction. Talking to them it was oblivious they just pushed my claim through without weighing all my evidence. I have zero faith in the Chicago RO or any for that matter. Now I was told the appeals will take 3-5 years to even be seen by a human again. Way to go government, taking care of those who afforded you the job you have..

Berta, they denied my first IMO and sent my claim to appeals in June 2013. The ms specialist didn't word it right. I then went to my dx'ing neurologist and what I posted last is his IMO. So the va won't see it until they look at my appeal. I was not given a C&P exam they just looked at my file and seen i had been out since 1992 and I had a weak IMO and they rejected it. I have tried everything but they are harder than I though on proper wording. I just hope the IMO I posted is more solid.

Berta I posted what the va said for why they denied it but it didn't really say much in my opinion. Just the emergency room thought it may be an ear infection and gave me an iv and told me to see my primary care doctor and I did. The va jumped on the er's notes. My PC dr sent me for an ear exam and it came back no ear issue and then my PC dr. Told me if it didn't get better to come back. In my medical record my PC dr wrote etiology was uncertain and it will probably get better in time. It did go away after about 4 months. I wish they cared as much about us veterans as we care about this country. Thanks Berta, the va has tried to call me 3 times since last week and every time they call it doesn't ring just goes straight to voice mail and when I try to call back they say high volume call back later. I called my pa and they can't see where the va tried to call and told me must be something wrong with my phone...they are no help what so ever..

Well sent senator durbin (il) an email last week and still no response. He must have rock star emails, too many to answer within 10 days, I'm sure he gets a lot of mail. hope getting him involved doesn't make it worse. But it has been 30 months and now I'm told 3-5 more years. I feel like I have nothing to lose now.

Most of us here will agree with that.

I suggest you go to IRIS:

File the inquiry as a Complaint about their service (there is a pop down box for complaints.)

Tell them the phone call situation ( it could be very important regarding your claim)

ask them why they called, and ask them for the status of your appeal ( if they in fact did receive the newer IMO after their denial.) You can verify if the IMO is there, as well.

I also suggest asking for email or snail mail responses to IRIS.

This way you have hard copy of what they said.

I always write any IRIS complaint I have (or even a general status question)

in my Office Org program first so that I can edit it, to be sure it gets to the point, with specific questions,then I copy and paste it into my inquery.

and in the case of IRIS complaints I have filed, I usually need to edit the bad words first.

I must admit my first IRIS many years ago started out as "What the Hell is this".

I had such a serious complaint, they had violated my rights)they moved very fast on it.

But I dont advise getting that abrupt with them.

You are no where near having some of the problems many of us here have had with the VA.

I wish you had requested a DRO hearing after the denial........

Did you? Could that phone call be regarding a hearing?

One of the senator's underlings will handle this - not actually the senator.

Many times it just adds a little more time to your wait - but we can for now

at least - HOPE, this will be of help versus the 3-5 year wait.

first thing that I would recommend you do is, submit a letter to the VARO and request a copy of your C/P results. Once you have those then take them to a doctor that specializes with MS and have him/her review the letter and then if there is material that is refutable, have them write a letter for your notice of disagreement (NOD). Submit that new medical evidence with a VA FM 21-0958 and forward it to the VARO where your claim was adjudicated. You have a year to do this. You may want to obtain a couple of different medical opinions.

One additional thing, doing a congressional inquire is not what it use to be. Not discouraging you at all, but proceed with it if that is your want and desire. In my opinion, it would be better to have the new and material documentation when doing so.

I have submitted several congressional inquires for several veterans. The VA has become extremely numb to their requests. Use to be, they would stop and take care of that claim to pacify the congressman/woman. Again, it's just not that way anymore.

I think you would be better off doing what I suggested above, rather than going to your congressman. JMHO
