Proposed Change In Rating

Please, we need your help. All of this is VA business new to us. The VA is proposing to change my husband overall rating from 100% to 90% by reducing his TBI rating from 70% to 10%. What do we do? I am speaking on my husbands behalf because he is unable to do so. I hope that is ok.

What is the date of the letter that proposes to reduce?

I believe it will say you have 60 days to respond and it is best to ask for a Hearing on the proposed reduction,within those 60 days.

Can you scan and attach the Reasons and Bases part of this decision?

Cover name,.address and C file before you scan it.....

There are many reasons VA can proposed a reduction.

From 70% to 10% is a big reduction.

We can advise you better if we can read VA's actual words in the decision.

I have a question as to the rating

What is the 100% for?

Was the 70% TBI rating in addition to 100% for something else?

If so, was he getting Special Monthly compensation for 100% plus 60% ?

Sorry but I dont get the math here........

I believe you only have 30 days (it may be only 21 days), from the date of your letter, to request a hearing and failure to do so will result in the reduction taking place as scheduled. Having the hearing can stop or delay the reduction taking place as scheduled. A hearing is probably your only way to stop this, without losing a yrs benefits while you fight to regain his 100%.

Yep 30 days to respond to have the hearing. Then usually around the 60 mark you will have a hearing.
