Question

good afternoon everyone..
so i just checked my benefits and i found out that i was awarded 100% P&T.
i had a 10% disability due to Tinnitus, and now with the last claim (PTSD) having been approved, i've gone up to 100% P&T. i know if you're 100% P&T for mental is just like IU, it prevents you from working, but what if you had another disability (like in my case), would you still be able to work? or you can't because the PTSD is the more severe disability.

I am confused the VA has just told me I can work my Union job because I have reasonable accomadations keeping me employed there. They want to get me P&T relating mostly for my TBI.

Congratulations on your 100% P&T. It's often difficult to get a 100% P&T rating!

Matters that may be of some concern - - - A PTSD 100% rating can cause some VA induced problems.

1. The Biggie!

If the VA has you listed as not competent to handle your financial affairs,

they will usually appoint a "Fiduciary", which can be a big ball of trouble!.

If in fact you are competent, get some sort of statement of competency, and immediately appeal the VA incompetency.

In some areas, a statement from a doctor can do this. In others, a court can issue a competency ruling. .

2. The VA has had a history of adding PTSD awarded veterans to the "Brady" list.

Again, the county court or a doctor may be the best place to get something to refute/reverse the VA's

actions. (It's a heck of a lot easier to get on the list than off!)

Spend any retro award money carefully!

In not a few cases, the retro amount can be more money than a disabled veteran has ever had at one time!

Pay off outstanding debts to avoid future interest. (If that's a goal!)

Salt some away, and invest what you think proper.

Spend some on a vacation, hobby, or other fun thing! (All work and no play, etc.)

VA disability (100% P&T) for a "mental' rating generally precludes working at "gainful employment" (although there are limited exceptions possible)

The other 10% rating is not applicable, as I understand it.

I agree w/Chuck. You can't work due to your 100% PTSD rating, which includes the inability to work in it. That 100% rating is worth about the same as earning $40k a yr in the real taxable world. If you're not receiving SSDI, I would apply now.

My VA + SSDI is about $47,500, tax free, which would be about $60k in the taxable world. In my area, the northern part of Vermont, the average wage is $25k - $30k, so I'm surviving quite well.

You should be able to get the SSDI you paid into.

Total occupational and social impairment, due to such symptoms as: gross impairment in thought processes or communication; persistent delusions or hallucinations; grossly inappropriate behavior; persistent danger of hurting self or others; intermittent inability to perform activities of daily living (including maintenance of minimal personal hygiene); disorientation to time or place; memory loss for names of close relatives, own occupation, or own name

This is the 100% rating for a mental disorder.

Don't forget to apply to your branch of service for CRSC (Combat Related Special Compensation)!! They will determine if any of your VA compensable disabilities are "combat related" and pay you more $$ in addition to what you may receive from the VA and SSDI.

Good luck and congrats!
