Bva Just Made Decision And Sent It To Amc Is This A Remand?

Question

I just looked on my e-benifits and it said Decision & claims file dispatched and mailed my decision to me and sent to progress office amc on 1/6/2014. This appeal is over 7 years old. Dose this mean a remand? I went thru that with one of my other appeal and it took over 1 year to approve that remand. Is it possible that it was approved by the bva law judge? Thanks for your help.

Normally they send the file back to the RO to complete the rating and the payment. I will keep my fingers crossed that is the case :) My file has not gone back to the BVA yet. I am still waiting on the AMC to "authorize" the granting of my claim that was sent to me in an SSOC. I think yours is moving faster than mine. LOL :)

I suspect they granted your claim at the AMC which is authorized to do so in addition to authorizing the rating, the % and the retro. They just did mine on Jan. 28th- all the way back to 1994. Having the files sent back to a VAMC indicates other issues that will require a new C&P or update of an existing med. file. Relax. I think you're inside the wire now. You're in luck. They're so backlogged they are handing out money like necklaces at a Mardi Gras parade.

Thanks Jeepers and Asknod. I went to my e-bennies last night and I could not beleive it. They took me From 60% to 80%. The ebennies said my effective date is Jan 1 2014. This is the month that bva law judge reopened my claim from 2005. I am hopeing I can go to 100% but who knows? I have to call dav and ask but I have little cofidence in them. I am thinking I can file a new claim for a better eed. I wanna thank everyone for there help over the YEARS. THANK YOU!

You might be able to successfully challenge the EED with a NOD. I wouldn't think of a filing new claim ,(if you mean for the same disability) when you still have appeal rights.

Maybe best to wait for the actual decision to see how they determined the EED.....

If you can scan and attach (Cover C file name address first) their reasons and bases part and the evidence list here when the decision comes, we can better advise on how to attack the EED.

Are you still employed?

If not you could file for TDIU ( VA form 21-8940)and attach that to the NOD and refer to it in there.

Geez, I forget what I know sometimes....

they are taking you up to 80% ,therefore if they are aware that you are not employed ( or even if they don't know) the decision should contain a statement as to possible TDIU consideration and maybe they will send the TDIU form with the decision.
