Question

Hello everyone and thank you for reading my topic.

I have a question and I have been seeking legal advice on it as well.

I was discharged from the Navy back in 2005 with a "personality disorder". I had been going to the psychologist on base in Pearl Harbor about grief and anxiety issue steming from the loss of several friends and family. What happened was my grandfather, my uncle, my aunt and 2 cousins as well as my father had all died in the range of 1 month. So they put me on limited duty and eventually discharged me. I had never been in trouble before that, during that time nor afterwards. I had been a stand up sailor and only wanted to serve my country as well as provide a solid future for my child. But having so many family member and service friends pass so close together did create a sense of depression in me. So after I got out of the service I immediately filed a compensation claim. I was told that what I should do by even the doctors on base. So I did and was denied for 4 years until I reopened the case they gave me non service connected pension since at that time I was low income and almost homeless. Over the years I rarely see my prescriptions that I have to take for the condition. I even went to the local VA clinic and the lady there just completely brushed my issues under the rug when I told her without my meds I can't sleep and have other issues. She later called back stating she did not know I had a rating under the VA and that I was diagnosed with these conditions. I was recently looking over my 2005 denial letters and it stated that service connection could not be approved because there is no prove that the condition worsened while I was in the service. I had never had depression anxiety grief issues prior to joining so how is that legitimate? the VA rated me under a non service connected pension at 80%. For the most part I feel like I have fallen through the cracks here and I know I need to get my rating from non service connected to service connected but I don't understand how. Do I need to see an outside doctor and have them provide evidence? Should I try to find an attorney?

If some parts don't make sense I don't type very well sorry.

What does your dischage papers say under the discharge code?

Did you go in front of a med board?

Did you receive severance pay?

There was a reason you were kicked out, there is a paper trail of some kind........this is the key in most cases.
