Ssdi 1St Denial

Question

I have applied for SSDI and found out today just after a few weeks that i was denied. No exams only the adult questionnaire that I filled out. They said they went off my VA records as evidence.

Im unemployable and haven't been employed since August 2013. I also have a letter from my last job describing that I was laid off due to missing to much work and also due to all my conditions that I could no longer perform my duties. My VA PCP letter stating I'm unemployable, VA ILP home assessment counselor stating severe PTSD and unemployable, VOC rehab stating in unemployable and unemployment saying I was denied and unemployable. All this was submitted to SSDI as evidence as well.

Conditions:

PTSD

Anxiety

Depression

Bilateral knee derangement

Hypertension

Lower back pain

Left hand medial nerve damage

SSDI said we do not have sufficient vocational information to determine whether you can perform any of your past relevant work. However based on the evidence on file, we have determined that you can adjust to other work and do not meet requirements for disability benefits.

That really knocked me back. Guessing VA increase for all above will be denied as well, its just my luck.

My SSDI was denied too. Don't be surprised. My SS denial letter stated I was capable of light lifting even though my exam and claim is for PTSD. Here is the last two paragraphs of my Diagnostic Impression from the Psych SS Examiner:

Mr. (xxxxxx) does not have the ability to interact appropriately with the public given his trauma related anxiety, which tends to manifest as aggression. He does not have the ability to appropriately interact with a supervisor or coworkers for the same reasons. He does not have the ability to respond appropriately to usual work situations and to changes in a routine work setting for all of the aforementioned reasons.

It is not likely Mr. (xxxxxx) could function in most entry-level positions on a full-time basis given the severity of his current mental health symptoms complicated by previous employment experience and precarious medical conditions.

Amicus, Sorry to hear of your troubles. I am waiting results of my recent C&P exams for an increase. The Physical Doc put that I can not work in Physical Environment, and PTSD Doc put that I can not work in a Professional Environment, statements like what yours said. Knowing the VA, they will probably say that I can be a Psychic or something in that Career Field, Lol!

Hell, I could be a Psychic too! I'm gonna hold my envelope up to my forehead and channel the netherworld......"DENIED!".

Saints,

This is a legal case that will affect your quality of life forever so it's good to expend as much energy as you can preparing it.

I talked with attorneys Before filing for SSDI and they both said, "After you're denied twice-contact me".

So, like Dick said, it's SOP unless you meet one of the listed ailments in the Blue Book http://www.ssa.gov/disability/professionals/bluebook/AdultListings.htm you are denied; the fortunate thing is your first denial was quick so now you can get to work on winning.

Hadit member fanaticbooks has wonderful site http://www.howtoassemblevaclaims.com/ssd.html which I used to be successful.

You'll want RFCs Residual Functional Capacityy forms and that self report Navy04 mentioned http://vets.yuku.com/topic/2822/SSDI-Self-report#.UwtfjIXPvNo

Get to work!

I have been working on the self report and have a meeting with a lawyer today. I just couldn't believe I was denied so quickly. I met a lot of their disability requirements and have letters from my VA PCP, VA ILP program and also VA home assessment social worker all stating I'm unemployable by employment and as vocational.

also lotta good vids on u tube on what to say and what not to say, the SS has a way of twisting things around to use against you. When u go see a lawyer be prepared for this question... what makes you unable to work. they will lots of times ask you this, to see how you will react. if you are asked that by a judge. you will react the same way. Have a good answer ready, look them right in the eyes, and tell them why you cant work. Be prepared.

Do you have a link to those videos you mentioned? My wife has her hearing in November, for SSDI due to ulcerative colitis, and she is very nervous.
