Ssdi 1St Denial

Question

I have applied for SSDI and found out today just after a few weeks that i was denied. No exams only the adult questionnaire that I filled out. They said they went off my VA records as evidence.

Im unemployable and haven't been employed since August 2013. I also have a letter from my last job describing that I was laid off due to missing to much work and also due to all my conditions that I could no longer perform my duties. My VA PCP letter stating I'm unemployable, VA ILP home assessment counselor stating severe PTSD and unemployable, VOC rehab stating in unemployable and unemployment saying I was denied and unemployable. All this was submitted to SSDI as evidence as well.

Conditions:

PTSD

Anxiety

Depression

Bilateral knee derangement

Hypertension

Lower back pain

Left hand medial nerve damage

SSDI said we do not have sufficient vocational information to determine whether you can perform any of your past relevant work. However based on the evidence on file, we have determined that you can adjust to other work and do not meet requirements for disability benefits.

That really knocked me back. Guessing VA increase for all above will be denied as well, its just my luck.

You need statement from a doctor saying you are totally disabled for at least one year. This is what SSA wants to hear. Like VA they do not connect the dots. I got SSDI in three months due to two statements from my doctors to the effect as I state above.

I have seen these people in action.

The original claim is filed and it goes to your state level department of disability services or DDS.

They deny the claim and you have to ask for reconsideration.

That reconsideration goes back to the same bunch of folks who denied it in the first place.

You ask for reconsideration again. This time it goes to SSA. This is the step that you retain an attorney.

The attorney fills ou the forms and the disability questionaire and asks for an Administrative Law Judge Hearing.

The whole process is very time consuming.

My attorney once told me that 60 percent of all claims are denied at the state level and 80 percent of the 60 percent get approved at the ALJ stage.

Here is some sound advice: Make an appointment with an Occupational specialist and have them fill out a report stating what you can do or cant do, ( Functionality report)

Good attorneys have one in their network.

Call ALLSUP. We were denied twice. Requested a hearing. Called ALLSUP. They got our claim approved via a review hearing before that actual hearing date. The actual hearing date was 1 year out, but ALLSUP resolved the claim within two months.

This is not an ad for ALLSUP, however they did answer the phone and we could call at any time. Also, they set up a web page for you so you can track you claim, similar to eBenifits. I had called two different SS lawyers before them and never got a call back.

They are not lawyers, however I think they are better as they know what they are doing and don't wait around. They could have made substantial more money waiting to got to the actual hearing. 25% of back pay for 10 months is what they gave up by settling early.

Just an idea that worked for us,

I was denied also, they said I made to much money I challenged that and ask for and repeal. The second time I was told I did not have enough credits. Now I don't have 40 credits so they say. I asked being a 90% disable veteran have any bearing. They did not answer my question. So my question here is,, DOES THE 40 CREDITS WEIGH MORE THAN BEING A 90% DIABLE VET?

Sorry to say that if you don't have enough credits, or have not worked 5 years prior to submitting a claim for SSDI, you have no chance bud. I have tried to help quite a few Vets in the last 2 years, but due to those facts most of them were unable to get SSDI. As far as being 90% VA, that does help, but not if the SSA says that you don't qualify for SSDI in the first place. That is why I stuck it out and worked until the last moment that I was unable to work for that reason. There are a lot of Vets that do not know or have not been informed about the 5 year working rule. What a SSA big wig from Austin told me last year, which makes sense is, "Why did it take someone more than 5 years to apply for SSDI if they know they are sick and have not worked in a long time". It is a sad reality, but thanks to Hadit and the good folks on here we can make sure and keep the word out. Good luck
