In Need Of Dro Job Discription

Greetings,

I am trying to help another vet with his claims. The DRO is refusing to use edivence on 2 C&P exams performed by 2 specialists at a VAMC which gave their opinions that were greatly on the side of the veteran, now the DRO wants another C&P exam for the same condition. (The multiple C&P exams were done less then 6 months ago).

I am concerned the DRO has no clue what he or she is doing and if he goes back for yet another C&P exam for the same issue who knows whom he will get (General MD, PA or God forbid a N.P.) I am going to try and challenge this DRO. The veteran in question has many service related issues that make it extremely hard for him to get out of his home. The closest VAMC to us is over 70 miles. Can any one help me with some CFR regs? I have a few in mind, but need some guidence. Thank you and God Bless you all.

Dear Berta,

Thank you yet again for your help. No this is not the Buffalo VARO, however maybe he or she moved to the VARO in question (Ha-Ha). This DRO here appears cannot even follow VA's own regs and laws. Thank you again and God bless you Berta.

My DRO doesn't know how to read-I told the Inspector General that this VARO employs illiterates-

and it is an misuse,waste and abuse of of taxpayers money.

I also asked the Senate CVA to investigate them-

and will be asking my Congressman too

Even though I sent my DRO M21-1 regs- since she cannot read- it did not help- however -she was not able to read my IMOS yet somehow acquired enough reading skills to read the VA's dumb expert medical opinion yet still she could not read my IMOs or a single pice of any of my medical evidence-

If the VA had not killed Rod a decade ago-based on the VA expert opinion -this VA doctor sure would have killed him by now-Dr. Bash liked the way I put that-and also that dumb doctor gave much support for my claim-in the SSOC but is so dumb she probably did not realise it-and of course the VA focused on her inept medical statements.

Based on this:

I would have the vet send the DRO a letter-copy to the VARO Director stating that he already satisfies the criteria of Relative Equipose a.k.a. Benefit of Doubt and wants a proper decision and award made on his claim and refer to this attached in the letter as to how his evidence should be properly weighed.

Here is the reg he should attach to the letter: the reg is near the bottom- this is from M21-1 and it is a psychological ploy when you to send them stuff that shows you have access to their job work manuals and job descriptions as well as 38 CFR. Highlight the 38 CFR 3.102 part.

Interesting how M21-1 puts it.
