Question

HI,

I am rated at 60% for Tinnitus, PN, Diabetes II. I filed a clam last November with the DAV, for PAD secondary to the DM II.

I had a C&P at the Saginaw MI. VA on April 25,this past Friday my claim was denied. I sent in 2 Drs. statements along with the ultra sound of my legs, with the claim in November. My DAV rep suggested we send in a Reconsider with new medical evidence.

I have never gotten a IMO from a Dr. who did not exam me. Is it worth getting one? How much weight could it have with the VA rating person when this Dr. is out of state, and never examined me?

I have a question that keep bothering me and my DAV SO never brought it up/ the denial latter stated that my private medical examiner did not provide a rationale to support her medical diagonals and did not write that she reviewed my medical service file.

Since I already have a SC for the DM II why would she have to review my complete C-file?

Hugh: I should have tracked down this post. Your claim denial date 4/25/14 indicates that you filed a claim for PAD within the last year or so, right. Your recent C&P was only for the claim of PAD and it was denied. You have never filed a NOD, right? So, on reconsideration, the VA Claims specialist agrees that your PAD is SC but with a 0% compensation rate. What has your VSO Rep advised regarding supporting evidence needed to get you to a compensation amount? Your currently at 60% SC, you need a 20% SC to get to 70% SC with VA Math. An additional 50% SC condition would get you to 80% SC. Where do you rank in the 38 CFR 4 PAD disability evaluation?

Hugh: Just got back from dinner. Please give the following some consideration, extra scheduler IU. At your current rating of 60% SC with multiple SC conditions, you don't qualify for the standard IU claim. However, if your "current SC Disability picture" is such that you are unable to obtain and or maintain "Substantially Gainful Employment," currently US Poverty Income level for 1 person $12???.00 per year, I think you should file a new FDC claim. An IU rating or a Denial Letter from the VA Vocational Rehabilitation Councilor would entitle you to the Michigan Property Tax Exemption, Big Bucks! You can thank that Rascally Republican Governor and Senate for passing the exemption in 2013.
