Conflicting Info From Davso's

Question

So last month my DAVSO tells me, after I ask, that all I need to send in for my NOD is a letter stating I am filing a NOD. Today I called the DAV and speak with another SO and mentioned to him that I am going to file a NOD and he said I have to send in a VA Form for the NOD. I told him his other SO told me I just had to send in a letter, he said no, what a cluster ______!!!!

I so I asked him why a personal letter I sent to my, when I filed the original claim, DAVSO was sent over to the VA with the original claim, and that letter was used in the denial. He stated they have to send over everything I send them, or the SO should have shreeded the letter or retured it to me WTF!!!

Anyone have a case like mine, where the VSO sent a private letter to the VSO that was not meant for the VRO and it was used in the Rating decision to deny the claim? If it happen to you, what did you do, if it did not is there anything I can do? Can I use that in my NOD or Appeal?

Keep in mind tat if the DAV does anything to hinder a claim, Their Arses can be sued. Do your claim yourself and if denied, Get an attorney.

Use caution when selecting representation. Many of these folks think they work for the VA.

Thanks, So I just revoke the POA with the DAV and send the NOD directly to the VA?

It was private note to the SO stating that I was not sure if Dr..........letter was going to help. The SO sent that in to the VA. WTF. I spoke with an attorney Friday about my NOD, and if I could sue the DAV, he told me I was going to have to eat that one, just let it go and focus on the NOD.

Holy Chit,

Soundslike the DAV is working for your RO. I also had DAV for my

case & they did absolutely nothing for me. They had no interes tin me & just regurgitated

info I already had gotten from RO.
