Hello ,

I am currently receiving TDIU been receiving it for 13years now, I applied for SS disability when I got my award with tdiu, but was denied several times..so over the past 13 years just been drawing tdiu ,my wife still works..my question is can or should I apply for my SS retirement beings I turn 63 on my next birthday... will the VA take away my tdiu....I Have not worked since 1999 Due to my disability's which acured while in the service..took me 3years fighting with the VA was awarded TDIU with P&T in 2003

I applied for my SS Retirement Sept 22nd & got it...I did not apply for SSD/SSDI .....(I Was denied for that) and just sick of the SS System.....I Been getting TDIU P/T for the last 14 years It's what got us through some very bad dark times.

I won my TDIU P/T in 2003 like mention above( that was God Send for this family).... Well sense then my wife had got a good paying job....and makes over 40.000 year & Pays her taxes, However I applied for my SS Retirement on Sept 22nd ..> they (SS) had this for form stating how much I would get and when how they paid ect,,ect,, well what worry's me is the form said ''I was not disable''... I was not applying for SSD.

I was not ask if I was getting VA Comp.

In short I am receiving TDIU P/T & now that I am at retirement age I went and applied for it & now this with the SS? what happens now?

I am disable and can't work.

I stop working when I won my TDIU claim & never worked sense, I waiting until I got retirement age to collect on what years I did work back in the day....they say I have to pay taxes on the retirement because my wife makes over 32,000....well that's fine obvious reduse my Retirement pay but that's ok ...I guess.

The SS retirement I get is 937.00...I don't won't to seem greedy but I feel I deserve to get that....if the VA stops my TDIU...I don't know what in the world we will do my?... wife is getting close to her retirement age and we had figured to have most everything paid for but our mortgage.

should we be worried?

Your SSDI decision was a farce. If you are able to work then you lose your IU. You have not worked since you were awarded IU. If I were you I would claim error on part of SSA and sue them in federal court because they are putting you in a catch 22. There has to be some recourse here.

I can't work due to my service connected disability.

I Have not worked in 15 years 11 of those years I been on TDIU P/T...I Got my Award in 2003 but it was noted that I had stopped working in 1999 which is true because I could not work b/c of my service connected disbiltys. the VA Retro the difference...not sure how long the VA counts the time your on TDIU? From the time you stopped working or from the time you win your award? for me it was back in 2003 but I stopped working in 1999...and those 4 years was the worst part of my life about how to make ends meet.

I Plan on calling my RO and get an appointment to go check on my C-File..

I was just wondering if any fellow Veterans on TDIU or 100% rated for their disability, if they filed for their SS Retirement? . ..and waited to file for the SS Retirement?

I may need you & the others on this matter in the future? & I appreciate all of you guys.

britton - I personally think you are being screwed by SSDI. You should have over $100k in back pay they owe you. If you don't want the money, you can just forget it but I suggest you contact an attorney, specializing in SSDI law. They will charge you based on what they win. I believe the current maximum, an attorney can charge, is $6300. No win, no money for the attorney. You can still collect SS retirement while pursuing SSDI. Your TDIU should remain intact unless you go back to work.
