Hello ,

I am currently receiving TDIU been receiving it for 13years now, I applied for SS disability when I got my award with tdiu, but was denied several times..so over the past 13 years just been drawing tdiu ,my wife still works..my question is can or should I apply for my SS retirement beings I turn 63 on my next birthday... will the VA take away my tdiu....I Have not worked since 1999 Due to my disability's which acured while in the service..took me 3years fighting with the VA was awarded TDIU with P&T in 2003

I was told at the SSA Office the SSA only retros back one year...from the date you file your claim for SSD any old claims will be ignored if older than one year....I am just fed up with the SSA....I know it use to be you get paid from back ever how long it took you to win but I guess the law has changed?

Sure I would love that kinda of money but if we can just make ends meet after my wife retires that's all we want.

we still have a mortgage and probably won't have it paid off before we die.

I think carlie nailed it for me...I can get SSR & still receive my tdiu b/c I am not working...the only thing I don't like about it I have to pay taxes on it because my spouse makes over 32.000 a year but she is nearing retirement. I get 937.00 month on SSR Before taxes so I may just end up with around 740 750 a month after taxes oh well every little bit helps.

britton - 1st rule: never believe anything SS tells you! All correspondence "should be written" because they cannot be held responsible for anything "they say."

A good SSDI lawyer can make them go back more than a year, if you've actually had a previous claim that was denied.

I contacted a lawyer, who teaches at the Vermont Law School, and she advised me there was nothing I could do. I then contacted an attorney specializing in SSDI law and it took her about 6 months to win my claim and get me 7 yrs retro.

This will be my last post on this subject as it appears you don't want the $100k retro.

I understand I think I'll just wait now since I sign up for the SS Retirement receiving it got my first check for Aug last week..I just have to get a IRS form and have the taxes taken out. Maybe things will be alright.

SSDI went back 3 years retro for my husband's PTSD. It was awarded on a reconsideration of SSDI award for a NSC (at that time NSC ) stroke SSA tried to talk him out of filing the recon request and a SSA lawyer would not help us. He really didn't understand PTSD, this was years ago, and was very surprised to learn from me that he had lost 4500 bucks because he refused to help us with the recon request.

I agree with PR to seek a good SSA lawyer because I know people who get SSDI because of severe hearing problems that cause severe speech disability. If SSDI knew of the TDIU and the Voc Rehab statement,and that you did meet the 5 year prior to application SSA work history criteria, I sure would fight them on this.

However, do what you want to do, ...this info here from everyone might help someone else out there reading it.
