  • Can a 100 percent Disabled Veteran Work and Earn an Income?

    employment 2.jpeg

You’ve just been rated 100% disabled by the Veterans Affairs. After the excitement of finally having the rating you deserve wears off, you start asking questions. One of the first questions that you might ask is this: It’s a legitimate question – rare is the Veteran that finds themselves sitting on the couch eating bon-bons … Continue reading

6 Months... A Decision Has Been Made.

Recommended Posts

Hello everyone,

I just wanted to give some information on my success with getting an increase for some S-C disabilities. My claim was actually held up for 2 months from a VSR at the VA in Los Angeles (Wilshire)- They had said it was filed, but upon checking Ebenefits as he told me to do- 6 weeks later- nothing had shown as filed. So I took it upon myself to walk it into the federal building myself and low and behold that following Monday it showed up on eB's... as filed on the date I walked it in.

This is the second time I have attempted to allow the VA's reps assist me and every time they screw it up. *smh* So for me no VSR/ VSO's I just can't... I would like to trust them, but it seems when i try to let them "just do their job" they don't. go figure.

ANYWAY.

3/14/2014 - Claim for increase was filed (FDC)... (currently 40%)

6/20 - QTC exam

7/3 - VA received QTC results (eB::: Development letter sent)

8/01- VA magically lost original claim paperwork

8/2- Uploaded claim paperwork through eBenefits

8/15- VA confirmed they had received the original paperwork uploaded. (eB::: moved to Preparation for decision)

9/15 - EBenefits reflected claim closed/complete (Decision notification sent/ development letter sent/ appeal possible)

9/16 - A8 (Benefit Summary) reflected my new rating (60%)

9/17TODAY- Called Peggy and got the callback option and my call was returned within 30 minutes. The woman who assisted for verification purposes informed me that it was complete, she cannot tell me what the decision is- however, you have retro pay authorized for Sept. 15th. Below 3K which is fine by me- anything is better than nothing- So now I am waiting for my retro to hit my bank and the BBE. (Big Brown Envelope)

and tomorrow 9/18 is my birthday- at least I can enjoy it knowing my claim has indeed been handled 1 day short of the 6 month mark. Keep the faith and stay on top of your paperwork.I agree with most, which is your timeline totally depends on what you're claiming and ensuring you are making your appointments, sending in documentation requested ASAP, and do not forget to FOLLOW UP! Technology cannot be trusted sometimes lol... If it says uploaded that's fine, but 2 days later I will cll anyway because, I need a human telling me they have gotten it. Hopefully you all are getting some quicker decisions as well. Looking forward to interacting with you all.

I believe a letter to whatever agency your VSR worked for describing the situation (no editorial, just the facts), copied to your Congressional reps might be in order. There should be some accountability for the fact that he/she cost you six weeks, although had it not been for your taking the initiative, it could have been much worse.

So this company sent me an offer to drop my mortgage rate down 3% to 2.5%.
No out of pocket expense to me. All fee financed in new loan.
To me it seems too good to be true.
Has anyone ever used this company?
I'd hate to ruin my first home purchase by refinancing with a scam company.

Any help/ knowledge is greatly appreciated.
      Thanks.

Back in 2019 this statement was made to another individual.  I am puzzled.   I am currently 70%.  I became 50% back in 2016, 70% in 2019.   I had health insurance and kept it after I retired, plus MEDICARE, TFL (mil retiree).  I didnt pay any co pays due to having three insurances at the time, but VA billed my MEDICARE and civilian insurance, which paid the Dr visit and  my prescriptions by civilian ins.  TFL always came up with some excuse not to pay anything for years.  But the payments dont go to the VA Dr I see, but someone else I've never seen at the RO billing office.  I suspended my civilian health insurance this past January, therefore I will only have MEDICARE and TFL.  So are you saying that they shouldnt be billing the companies.  I do understand about the medications.

      Hello,
Does anyone know how the VA rates keratoconus currently? The diagnostic code is 6035. I am new to all this and have been unsuccessful in finding the specifics using the VASDR. I have been diagnosed with bilateral keratoeonus and would like to better inform myself on how it is rated. I am awaiting a decision back from the VA but my case and evidence is overwhelming. To date, I have found only one article dating back to 2008 that appeared to show the  minimum rating use to be 30% but I am unable to gauge the accuracy. Any assistance is helpful.

I remember other QTC exams being uploaded to Blue Button, but cannot remember where they are located in the reports.  Does anyone have any info on where they are located within the medical record available on Blue Button?

Received a letter from a company called QTC, which I found to be strange since I am rated at 100%.  Called the company and asked them questions and they stated that they are a 3rd party agency hired by the VA. The case officer informed me that I have a claim under the VA but the fact is that I don't have any claims active once I was rated at 100% I stopped.  So I was under the impression that this company was either a scam/fraud or something.  Normally the VA contacts you directly, but?
Called the VA to confirm this "QTC" company, and the VA informed me that my TBI injury is not a permanent rating so therefore follow up exams can be issued to see if symptoms have improved or gotten worst.  I was under the impression that once you reach 100% and no further exams were needed.  Now I am confused and perplexed and scared of losing my benefits that I worked so hard to get.  Basically, I can't live without the benefits since I am not working or barely working for that matter.
The "QTC" company said that an "ACE' exam will be done by a physician.  (ACE) Acceptable Clinical Evidence...  So apparently this "QTC" company is a company that is hired by the VA to assist them...
So, can anyone guide me or provide me with some information about this process?  Thank you in advance~

    • I already get compensation for bladder cancer for Camp Lejeune Water issue, now that it is added to Agent Orange does it mean that the VA should pay me the difference between Camp Lejeune and 1992 when I retired from the Marine Corps or do I have to re-apply for it for Agent Orange, or will the VA look at at current cases already receiving bladder cancer compensation. I’m considered 100% Disabled Permanently

    • 5,10, 20 Rule
      The 5, 10, 20 year rules...

Five Year Rule) If you have had the same rating for five or more years, the VA cannot reduce your rating unless your condition has improved on a sustained basis. All the medical evidence, not just the reexamination report, must support the conclusion that your improvement is more than temporary.

Ten Year Rule) The 10 year rule is after 10 years, the service connection is protected from being dropped.

Twenty Year Rule) If your disability has been continuously rated at or above a certain rating level for 20 or more years, the VA cannot reduce your rating unless it finds the rating was based on fraud. This is a very high standard and it's unlikely the rating would get reduced.

If you are 100% for 20 years (Either 100% schedular or 100% TDIU - Total Disability based on Individual Unemployability or IU), you are automatically Permanent & Total (P&T). And, that after 20 years the total disability (100% or IU) is protected from reduction for the remainder of the person's life. "M-21-1-IX.ii.2.1.j. When a P&T Disability Exists"

At 55, P&T (Permanent & Total) or a few other reasons the VBA will not initiate a review. Here is the graphic below for that. However if the Veteran files a new compensation claim or files for an increase, then it is YOU that initiated to possible review.

NOTE: Until a percentage is in place for 10 years, the service connection can be removed. After that, the service connection is protected.

      ------

Example for 2020 using the same disability rating

      1998 - Initially Service Connected @ 10%

RESULT: Service Connection Protected in 2008

RESULT: 10% Protected from reduction in 2018 (20 years)

      2020 - Service Connection Increased @ 30%

RESULT: 30% is Protected from reduction in 2040 (20 years)

    • Post in New BVA Grants
While the BVA has some discretion here, often they "chop up claims".  For example, BVA will order SERVICE CONNECTION, and leave it up to the VARO the disability percent and effective date.

I hate that its that way.  The board should "render a decision", to include service connection, disability percentage AND effective date, so we dont have to appeal "each" of those issues over then next 15 years on a hamster wheel.

    • Finally heard back that I received my 100% Overall rating and a 100% PTSD rating Following my long appeal process!

My question is this, given the fact that my appeal was on the advanced docket and is an “Expedited” appeal, what happens now and how long(ish) is the process from here on out with retro and so forth? I’ve read a million things but nothing with an expedited appeal status.

Anyone deal with this situation before? My jump is from 50 to 100 over the course of 2 years if that helps some. I only am asking because as happy as I am, I would be much happier to pay some of these bills off!

    • I told reviewer that I had a bad C&P, and that all I wanted was a fair shake, and she even said, that was what she was all ready viewed for herself. The first C&P don't even  reflect my Treatment in the VA PTSD clinic. In my new C&P I was only asked about symptoms, seeing shit, rituals, nightmares, paying bills and about childhood, but didn't ask about details of it. Just about twenty question, and  nothing about stressor,
