Quick Question On Concurrent Receipt

Question

I talked to a veteran who is rated 80% on lumbar spine, is TDIU, and went over 20 in the military.

Is he barred from collecting ALL of his military retirement pay? He's not considered 100% disabled?

If not, can a veteran switch from 100% TDIU to 100% schedular if the disabilities allow it? I'm finding that he hasn't claimed all of his conditions, or the side effects from the medication he's taking. I believe we can get him over 100% schedular.

That last 20% is hard to get. It can go both ways. Personally he is risking a lot. In 2009 he gets all his pay (Oct). What' he missing. 5-6k? He's going to risk all he has?

Now if he has a conditon and the shoe fits. Go for it. Ie. Ratings for his condition call for 100%.

More important is "How was he hurt?"

If it's combat related he needs to apply for CRSC. It's not automatic.

This Explains it all. He gets most of his retirement NOW.

The concept of "Combat" is pretty broad for this purpose. AO disabilties are considered combat as are many instrumentalities of war meaning dangerous duty. People who get hurt in certain kinds of training accidents are eligible.
