C&p Examiners

Question

how much weight does a c&p examiners "opinions " have on tdiu claim. I am 90% total with 70% for major depression disorder and receiving SSDI for that. Applied for iu and examiner pretty much said i was more than ok and stated all sorts of his opinions and negative things that hurt my claim. Then va denied claim

It must bc i just checked ebenefits and not only was iu denied i was reduced from 90% to 70%. That's even with ssdi that i just was approved for solely on va med records and that was in the evidence. So i just got totally screwed

Unfortunately it appears that C&P examiners are given more credibility than a private physician because they can see all your medical files that a private physician does not have access to. In my husband's case, he was examined by an APRN who is in the VA nursing department and they took her determination over that of the podiatrist. Fortunately for us the DRO failed to look at the letterhead our "private" physician had written. It was on VA letterhead because she is a VA podiatrist. At BVA waiting on an appeal for CUE! Read over your C&P exam for any inaccuracies as there were several in his.
