Records Destroyed.

Question

A year ago I had discovered incorrect dates on my ratings. I went to my dav so with copies of my ratings. He looked on computer it showed my paper records destroyed and incorrect dates down for my ratings of tdiu. 2007 instead of 1995. He advised me to wait until this yr when I had 20 yrs on my rating of tdiu to get it corrected. When I went in jan to see him he told me my records were being scanned onto disc and not to rock the boat as I might get my tdiu taken away. I said wait, I thought my paper records were destroyed over a year ago what is being scanned? Anyway he told me my 70% rating was correct witch was 1993 effective date. But my IU rating was 2007 instead of 1995 which it should be. He also said it showed me being paid at the 100% rate from 1998 instead of 1995. Wanted to know if I had bank statements back to 95 showing deposits which of course I don't. He also said the 2007 date showed something like General Individual Unemployability. I called a dav nso at st Louis, he advised to wait until scanning was done in about a month so all info was there for him to look at.

I have copies of all my ratings, a old champva card of my wifes showing effective date of 1996 and my commissary px card. I thought I would be able to relax after 20 yrs with no worries on being reduced, now my anxiety has worsened over this.

I need adivice on what to do.

Has anyone specifically stated to you that the ChampVA card and commissary card are not evidence of an earlier effective date, or are you assuming this on your own? I would sure press that issue based on those pieces of evidence, otherwise, the VA had better give you an alternate explanation as to why they were issued to you in 1996. I wouldn't give in easily on this point if I were in your position.

No, they haven't told me the cards are not evidence. The DAV SO did say there was a gap in payments on his screen. And the 2007 date the va has showed General Individual Unimployabilty rather than individual Unimployabitly on following datesl Does anyone know where you contact to get a payment history? Seems like the checks come from Texas.

I have copies of my ratings and probably a box full of other records. What I don't have is copies of bank statements back to 95 showing deposits at 100% rate. I doubt anyone has. I found an article from the st Louis post dispatch showing two temp clerks were prosecuted for destroying paper records and entering wrong dates on disc in 2012 they were being paid bonus for how fast they could transfer data. I figured that's what happened to my paper records, when a yr ago my dav so told me my paper records had been destroyed and wrong dates entered on disc for my ratings. Then the so told me last week my records were being scanned on disc, I don't get it. You would think copies of ratings champva card commissary card would be enough to correct records.

The bank should have copies.

I am sure there is a trail of paperwork for your TDIU payments. The bank should have them. Plus having ChampVA and commissary card is proof. What about disabled vet insurance. Did you put in for free insurance when you got bumped up to TDIU? If you have VA insurance and you become Total you can ask for your premiums to go away and keep the $10,000. Also, when you began to keep medical care from VA with no co-pays there should be record of that and reason for that. The VA does do crazy stuff. Way back in early 1970's they began to pay me at 100% rate and then just suddenly stopped with no questions asked and no refund asked from me. Me and some other vet had the same name but entirely different SSA numbers and VA claim numbers. I do remember this guy lived in Texas and I live in Florida. They would not listen to me when I told them they were making a mistake. I sent the checks back for a few months and then just began to deposit them at interest. They are dumb as a bagful of rocks. They also just stopped sending checks about 20 years ago because I changed banks. I told them I was changing and all that but they stopped them anyway. I got it going again but had to go to congressman who was a powerful guy on Ways and Means back about 20 years ago. So anything is possible with the VA.

I have already tried my bank, they don't keep records that far back. I have the disabled vet insurance with no premiums. what should I do next?

Effective when? Do you have any hard copy evidence in your files of this life insurance information, or can you try contacting them to get this information? Contact ChampVA to see if those folks can give you an effective date of initial coverage, in writing. Work any and every angle you can think of.
