Va Comp Increase

Question

I just recieved my va notice for increase in comp. for frostbite the doctor notes state cold injury r-l hands the dbq is xact diagnosis for rt and left hands but only comp. me for rt hand at 30% and no mention of the neuropathy claims im stunned- not really after 3 yrs this is all they can up with the increase puts me at 80% any thoughts

That might be the bilateral amount.

Yes it could be.

If I were you I would go to the VA Schedule of Ratings here, half way down the link the diagnostic codes and ratings appear, and check the diagnostic code as well as the ratings for frostbite.


"The veteran is service-connected for peripheral neuropathy of
the right upper extremity due to frostbite, rated as 20
percent disabling, peripheral neuropathy of the left upper
extremity due to frostbite, rated as 20 percent disabling,
peripheral neuropathy of the left lower extremity due to
frostbite, rated as 10 percent disabling, peripheral
neuropathy of the right lower extremity due to frostbite,
rated as 10 percent disabling, tinnitus, rated as 10 percent
disabling, chronic otitis externa, rated as 10 percent
disabling, and anxiety reaction, rated as 10 percent
disabling. His combined service-connected disability rating
is thus 70 percent, including the bilateral factor. "

In this case it seems that the peripheral neuropathy was due to the frostbite and therefore not rated separately.
