Please Help With Opinions

Hello all I am looking into filing a claim for headaches/migraines. I am currently service connected for knees ankles back tinnitus and depression for a total of 90%. My rep at the DAV recommended that I put in for it because of all the meds that I am on can cause them and he also stated that with all the pain I am in it would also cause them. I am not sure that this would be the best thing for me. I have not been seen for it because well its just pain and it will go away soon. I know dumb move but that’s the way I and probably a lot of us are. Also I am wondering about a couple of other claims. Here are my questions

1. Should I file for chronic headaches sense I have had them for years? I get headaches on average 3 a week and migraines about 2 or 3 a month where I go to bed with all lights off.
2. Gerd. I have been being treated for heartburn for about 15 years or so and the va has been giving me a prescription for omeprazole for 7 or 8 years now. Should I claim that?
3. I am wondering about IBS. I have been taking so many meds that I go to the bathroom from once a day to now anywhere from 3 times a day to once every 3 or 4 days. Should I file for this?

I honestly don’t know if I should file for these things. I do not like to mess with the VA but now it is time to finish the fight. Any advice would be much appreciated.

diver: I don't see any mention of your IU filing. Am I missing something? 90% SC in and of itself indicates a severe disability picture. Now, unless your earning well in excess of $12,400.00 per year, weren't you advised of an "Inferred IU Claim" on your last SC Award?

As for your question about the other conditions, if you have a VA or Private DX, file the claim. Let the VA figure it out. If any of them are Secondary to 1 of your SC conditions, great. The only problem is right now at 90% SC, you will need a New SC at 50% to get to the magic 95%. That's usually a tough nut to crack. While your at it, file a claim for IU on your E Ben site. Just start the VONAP Claim to establish your Retro date. You have 1 yr to complete the VONAP Claim. You have nothing to loose.

Thank you Gastone. I think for the iu I have 3 problems deferred planter fasciitis, hearing loss which will be denied, and ptsd which does not matter sense I have depression already and I think that's why they did not send me anything for iu. I am working now making over 45k but on March 20th I will be unemployed and going to vocational rehabilitation. I don't think that I can put in for iu while I'm doing that. I have not been diagnosed with any of the new things that my rep told me to put in for. I just can't stand to be around people and sitting in a waiting room drives me crazy. That is why I am asking for opinions. I know that if I do put in for them I will need to put the time in to get proper dx for them and I don't want to do that unless it's worth it.

Diver: The PTSD, depending on DX'd severity could quite possibly be an IU deal maker. The VA Vocational Rehabilitation Councilor will be the determining factor in deciding whether you are Re-trainable for Even Sedentary work. If your PTSD symptoms in addition to your other SC conditions preclude you from "Gainful Employment" you probably stand a good chance of getting an IU rating that would pay you at the 100% SC level. Just because your attempting Voc Rehab doe not preclude a IU award. Good luck and do some in depth IU Research.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
