The VA is working on a CUE claim for accrued benefits for me.
In 2012 they stated this:
Entitlement for accrued benefits for cerebrovascular accident under 38 USC 1151 is granted with an evaluation of 100% effective August 9,1992 to March 1, 1993.
The letter I received yesterday says they are working on the accrued claim under 1151 for the period from March 1, 1993 to October 1994.The established medical and legal evidence at time of this decision as well as at time of my husband's death warranted 100% under 1151, plus SMC for one vet, and two dependents from August 9, 1992 to October 14, 1994.
I cannot figure out how many months they paid me for using the original Aug 1992 to March 1 1993.
The amount was added tio the AO IHD retro but no audit came with the award, nor any rating sheet
CVA is supposed to be rated at 100% for 6 months and then the residuals, unless the CVA is catastrophic and T & P and the residuals are ratable at continuous 100%.
All of my evidence showed the stroke was 100% P & T.
Is Aug 1992 to March 1993 technically 6 months?
Any takers on how many months they owe me, if this claim succeeds?
