Fdc Pending Decision Approval - Timeline - Recent Experience

Question

Folks:

Anyone have recent experience with how long the Pending Approval Decision Phase is now taking? I know that are a lot of variables by location, # contentions, and complexities but it's clear that the "big push" to clear the claims backlog is on. Also, today I saw something said that claims prcessing accuracy is almost at an all time high?

The FDC program is relatively new but I think for the most part it seems to be working better than I expected it to. I did 2 FDC's early 14 for same Secondary Issue. I used wrong SC condition in 1st FDC and corrected it by filing 2nd FDC about a month later. Both FDC's stayed FDC's and within about 2 MOS I was notified of 1st FDC C&P which I knew would be Denied. At the C&P, I told the DR what was wrong with my claim and what the correct SC condition causing the Secondary issue was. He agreed with me, but said he could only address the "Wrong SC Condition" that the Rating Department requested the C & P DBQ on and would have to give it a negative causation. Said he really couldn't address my 2nd FDC claim.

At the very end of the C & P, he said his hands were tied as far as an addressing anything other than what the Rating Dept had requested. I asked him about him being a VA Dr and the regs regarding a VET's request for a specific DBQ from a VA Staff Dr. I requested another DBQ, he completed it and faxed it to the Rating Department as well as giving me a copy and placing it in my VA medical record. About 3 weeks or so later, I received the Award Letter for the 2nd FDC. FDC along with a very helpful VA Dr, worked for me. About 5 months from start to Award.

As long as your FDC stays an FDC, no matter how long the Decision takes, it's will definitely be shorter than the 11/2-2 years of the old Reg Axx Claim of yesteryear, right.

I think there is some good news and that is that my claim has remained an FDC despite the FOIA debacle that I had earlier. It's really bugging me that I don't know if my whole file was digitized and that evidence made it to the VBA raters? Like I said before, no one ever told me that a FOIA is considered a claim on it's own and could derail an FDC? However, I've confirmed that my FDC is still an FDC despite asking for them to cancel the FOIA. I credit that with my visit to the RO in which I found a senior VBA Rep that was helpful. That all said, 5 week from now will be the FDC 12 month mark on the FDC and I suspect I'll have my ratings answer within that time frame? Also, I "saved the date" a few months earlier then that when I filed my informal claim for the first (same identical contentions) contentions. So, if I get fairly good service connections on my claims contentions then there may be a good retro. In retrospect, I first was advised to outlined my illnesses by the VSO, then learned that not all of my contentions where clear to the raters. For instance, I have issues with Prostatitis and ED and she wrote up the contentions as "groin" which was clearly wrong and one of the reasons I withdrew my POA. So, like you, I also have some secondary's that I need to claim but I'm a lot smarter now after following hadit.com for the last year and a half.....now, for me...it's just a "waiting game"...and I'll get there now sooner than, later....good luck...

Here’s my Fully Developed Claim info:

Submitted Claim- 24 March 2015 (one contention)

VA closed Claim- 9 June 2015

There was no C & P Exam ordered or conducted for this FDC. My evidence I submitted appeared to be pretty solid and my eBenifits status showed UNDER REVIEW during the 77 days. I pray the outcome is positive! If denied will they send a SOC and will it be indicated on ebenifits, so far it just shows in the Historical tab closed claim: 9 June 2015.

Has anyone else received a positive FDC decision without having a C & P Exam?

Yes..folks do get postive results without having CP exams as long as their SMRs are very strong and the rater see's it that way also. Especially, if they were in these latest wars and spent a great deal of time in Combat and their C-files are up to date? It's all about you having the right "evidence' ammunition in your file to do battle with VBA. Also, some VBA raters appear to be more liberil then others when it comes to applying the laws, rules and regulations? A lot of that can be achieved by filing out DBQ's and getting your doctors to review and sign them beforehand. I provided 13 DBQ's for my FDC but do not have my claim finshed yet. I thought that I was completey done because I was in the Pending Decision Approval Stage for 9 weeks now...and the 1800 rep said so. Then all of the sudden after thinking I was done, I was contacted and told that I needed 3 more exams... then they would complete my claim quickly? I have a very complex case and so it will be very intersting how they treat me in terms of service connections....anyway...I'm praying for a great outcoem for you.....good luck and godspeed...

I am on pins and needles just waiting for the decision. I have checked eBenifits several times since yesterday since the CLAIM CLOSED status was posted on my FDC and yesterday sent an IRIS requesting for status. Thank you for your words of encouragement and I wish you the best on your claim as well.

I am in Pending Decision Approval for my FDC filed on 2/4/15 -I did not have a C&P for my FDC. I filed for my teeth secondary to my ED (Anorexia Nervosa). I was GOE in April and I pushed the "decide my claim" button late April. I submitted all I needed. The VA asked my dentist and specialist dentist to provide medical records which they did and then I went to Preparing for Decision on Tuesday and now Pending Decision Approval..

we will see!
