C&p Exams: How Do You See Your Results/notes?

This may or may not been asked before, so, I apologize ahead of time.

I filed my claim on 3/10/2015 and had my last C&P exams on 5/22/2015. My claim has since moved from "Gathering of Evidence" to "Preparation for Decision". I noticed that people are able to post the C&P notes from their visits. How can I find my C&P notes? Are they online somewhere? I've looked on myvahealth, but they're not on there.

I also had 2 C&P exams done in April and May this year. Same happened here and with others that have asked about them. They seem to not be posting them on MyHealtheVet recently. I was able to get copies from the clinic front desk, but not off MyHealtheVet. All the other exams that I have had from January 2015 and previous are in there.

My claim went to Preparation for Decision about 2 weeks after the exams, but then was kicked back to Gathering of Evidence because I submitted my post surgery information and a CUE claim for an EED. That was almost a month ago and no movement which sucks cause the C&P exams were favorable to me with an increase.

100% P&T Schedular !!

50%  Severe Obstructive Sleep Apnea, 40%  Fibromyalgia (GW presumptive), 30%  Right shoulder issues (Labral Tear surgery, arthritis, surgery post motor vehicle accident), 30%  Somatic Symptom Disorder (claimed as depression and anxiety), 30% Onychomycosis (nail fungus) right great toe, 30% IBS with diarrhea (GW presumptive), 10%  Hypertension, 10%  Hypothyroidism, 10%  Tinnitus, 10%  Right knee issues (meniscus surgery, arthritis),   0%  Right shoulder surgical scars,  0%  Right knee surgical scars,  0%  Erectile Dysfunction, 0%  Hypogonadotropic Hypogonadism, SMC-K  Loss of Use of Creative Organ

My understanding is that the notes from one's C&P exam(s) would be visible on that site, if the exams were performed by the VA. If the exams were contracted out, then the results will not be available until after a decision is reached on one's claim. Hopefully that is clear.

Detel, I have found my C&P exams available, except for my initial PTSD which was done by an outside contracted psychologist. Still not up 3 years after on blue button

70% - PTSD

->50% - OSA (Secondary to PTSD)

30% - Bilateral Pes Planus w/Plantar Fasciitis

30% - Migraines

10% - Tinnitus

20% - Back

0% - bilateral shin splints

Mine are not on MHV either. The x-ray results that were ordered for the ortho C&P are there, but not the C&P.

Both of mine were done by the VA.

It talked with MY Health VET customer service rep yesterday asking about why a c and p exam is missing from my information. She state that all c and p exams will be removed from MHV because they are not suppose to be in there it is only supposed to be available for the raters and RO's. So you better copy or save all your notes you have in MHV. She said they are removing them daily.

I do not think that is accurate. I can still see my C&P exam from last year on MHV b/c my C&P was done through the VA.

If a C&P exam is contracted out it will not be available until after a claim is decided.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.
