Hello,

Anyone know of a good forum for SSDI.

One that is as helpful as HADIT.

My wife is going to start (unless we opt out) SSDI Medicare in a couple months and we have questions.

The lady my wife talked to at SS did not see what we saw on my wifes SS webpage. There seems to be confusion.

Anyway,

Thanks,

Hamslice

Are you referring to opting out of SSI Part B or SS Disability??

My wife received SSD from age 62 to 66, when it converted to her SSI. Because of her Medical condition, we have always carried the enhanced Part B, cost about $140 per month with AARP's United health Care Plan. Little or no Hosp and Drs co-pays or deductibles. She was eligiable for CHAMPVA mid 14, so she'll get all of her RX copays back. CHAMPVA requires the Vet's spouse to have SSI Part B.

While we're on the topic of SSI. I meet with a few NAM vet's on a monthly basis, and the SSI topic has had a lot of coverage. Up until just recently, 1 Vet had opted out of Part B, claiming he'll never need non VA Medical Services. We all know we're covered for non VA Hospital Emergency coverage (If you follow the VA Notification Rules).

He recently had a medical emergency out of state, suffice it to say, he now has FULL SSI Part B coverage. I personally carried the Part B high deductible, cost $40 per month, for past 2 years. Just recently, switched to same plan as my wife due to need for Surgical Procedures that I had decided would be safer if performed at Non VA Hospital and by a much more experience surgeon. Personal choices, right.

My spouse has filed for SSD but not yet been approved.

She use to get her medical care at the VA and the specialty clinics but they closed the clinics to her.

so we ask ChampVA if they could suggest a good and reasonable supplement Insurance. They recommended (Sellman Insurance) 50.00 deductible.

I had to join American Military Retires Assc (AMRA ) (25.00 membership a year) to get the insurance with Sellman Insurance, it covers the other 25% what ChampVA Don't cover. its about 74.00 monthly.
but they have a 6 month waiting period for pre existing conditions but covers any new ones.

To join the American Military Retired Association you need to be 100%SC P&T.. & They have other benefits as well.

I used that without a representative to obtain an EED. A senior SSA clerk told me what to do, and how. A junior clerk at the same location had no idea what was going on, and wanted to refuse the paperwork. I got a receipt, and marked it to the attention of the senior clerk only! That worked.

My wife SS page now says that she will have "no cost Part A" and "no cost Part B" in October.

She is 50 years old.

My wife called SS and the lady said there would be a cost for part B.

My real concern is part D, as my wife has many prescriptions for her MS and other complications from MS.

I individually do not need private insurance as I am 70% VA, but I have insurance through work for me and my wife.

$3000 a year deductible and 350 a month premium is what (all) I pay a year currently. Last year I met our deductible 16 January and this year, 23 February. So you can see how much medical my wife needs.

If I cancel my private insurance through my work and have her on SSDI Medicare, I will need to figure out my out of pocket expenses. From what I hear, part B, 20% would be mine and that could be a lot concidering...

I could retire now, but then for sure she would have to be on SSDI Medicare only.

If I wait until I turn 60 (6 years), she would have SSDI Medicare and Tricare for life.

Anyway, got a couple months to make a decision,

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”
