Is it best to get a Representative on my behalf ? Claim filed again in May, 2014-I am waiting for Clinical Records

(misplaced Goodfellow AFB"). Served 1966-1969. I am stalled!

Do you mean you filled out a SF 180 at http://www.archives.gov/for your SMRs?

How do you know they have been misplaced???? Did VA say that?

Thanks Berta.....VA reports "No SMR" They cannot find clinical records "prior to discharge." Letter dated 9/8/82. I was discharged in 1969. I had a "top secret crypto" clearance. In Goodfellow AFB and was admitted to Wilford Hall HSP, Lackland TX.- Psychiatric admission in 1969-USAF INTEL 201-1

Have filled out 2 SMF 180s for each hospital in 2015

Honorable Discharge-end of duration of service

When did you fill out the 180s?

Did you request your entire SMRS and Personnel (201 ) file?

Interesting. My daughter was USAF INTEL classified for 7 years.Cryto and Vietnamese lInquist.

The Mil told her that her Top Secret clearance could be unclassified for any VA claims purposes.

I assume this clinical record is needed for a PTSD claim?

Have you ever applied for SSDI disability?

SSA got medical records for my husband that VA told me had never existed.

They were very extensive records and helped SSA award him for PTSD. But SSA does not really hold onto SMRs and VA recs too long.

Someone here recently posted other ways to obtain inservice records.

I will try to find that post.

Do I understand that VA said those records were missing in 1982?

Have they said the same thing since filling your claim?

That is, have you recently filed a new claim?

1982 Lawsuit then 2014 Disability Claim.

Claim has been sent Back to "gathering of evidence" From "preparation for notification" -

I have until 7/6/15 to contact (the hospital again???) and get those records back to VA.

Did not know if this was the time to contact some kind of Representative to assist.

You have given me alot to research (thanks for giving me some hope that records are still there)

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.
