Just Had C & . Doc Notified Missing Year Of Documents.

Like the title states I just had a yearly re-eval which I hate with every grain in my soul. And have lost weight over the stress this crap does, but to get to the point the doc let me know she had no documents or records since my last eval. What do I need to do to get these dirty rats my records? Is there an easy way to do this or should I just wait to see outcome first. A years worth of records is not being reviewed this is b.s. Also it was done by QTC how do I get a record of the exam from them? My attention span is short and it makes it hard to concentrate and read some of these very use full articles but I am working on helping myself and gaining what I can from this great site. thanks

Im guessing QTC is a private provider.

1) Did the VA refer you to them/pay for them or did you go there on your own?

2) if you went there on your own did you sign a release to allow the VA access to those records.

3) The Examiner will note what records they reviewed

4) If QTC is private etc call them up and ask for medical records office/records release. usually you have to fill out a form, and request what you want from them, ie xrays, doctors notes, etc. After every civilian doctors visit i request all the notes, etc. from them. I usually request "All Records relating to visits to any doctor,specialist, nurse for any treatments between the dates of XX/XX/XXXX- XX/XX/XXXX to include doctors notes, opinions, exams, xrays, blood tests and anything else not listed. Sometimes they will charge for this if its for "personal use" and not being sent to another doctor, if so you may want to cut out xrays, etc and jsut stick to exam/doctors notes.

DO THIS NOW. Get the records ASAP, let the people at the hospital know this is time sensitive for the VA and need it ASAP.

Collect the documents and then submit them to your claims intake center, find yours at (http://www.benefits.va.gov/compensation/mailingaddresses.asp)

When you do this, I would personally fax them to the number indicated along with a statement in support of claim and indicate in that statement what claim is referring to, and HOW MANY PAGES YOU ARE SENDING, along with what they are. I would even number the pages and indicate in the statement what each page consists of (general description) so that they cant say they reviewed the 10 pages you sent when you actually sent 50 and cant prove what they did or didnt get. Fax them and then send in a copy by mail CERTIFIED MAIL WITH RETURN RECEIPT. Keep copies of all of this, keep a third copy of what you sent just like how you sent it and staple the certified mail receipt to it and when the return receipt comes back, staple that to. also staple the confirmation of fax to that as well. keep all of it forever and ever. keep everything the va sends you or you to them for that matter, you never know when that may mean the difference between winning and losing, trust me i learned the hard way.

I would also then go to IRIS on ebenefits and send a message to C&P stating "XX June, 2015 I sent a statement in support of claim along with X Pages of Medical Evidence Treatment notes from private physicians at QTC.....I want this message to be included in my C File regarding this claim" then at least...hopefully at least one message goes through and is included in the claim file and is evidence you did send this in. So that in the off chance you are denied, you review the exam report and the decision from the rater you can look and see. If you dont see "Statement in Support of Claim dated XX June, 2015" which should match up with the date on teh statement you sent in then you know you would have a good shot at appeal to say they didnt consider all the evidence and when the VA comes back to say "You didnt send it in" you have proof it was received via fax, certified, return receipt and should be in your C-File.

Dont blow a gasket, anything with the VA is hard and frustrating, you have to put more redundancies in your dealings and communications with them than were in the apollo program to land on the moon.

70% - PTSD

->50% - OSA (Secondary to PTSD)

30% - Bilateral Pes Planus w/Plantar Fasciitis

30% - Migraines

10% - Tinnitus

20% - Back

0% - bilateral shin splints

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
