Does anyone know how long the Louisville RO is taking to process NODs? I have a very old claim that I had to file a NOD on 315 days ago and I have not heard anything from them. This waiting can drive a person stir crazy. Every time I call Peggy or chat with Epeggy I get the same answer that it takes 230 days to get a decision but I am well past that point. Any insight would be appreciated.

Let us know what "stage" you are in. A DRO review should be the fastest. Next, probably DRO video conference hearing.

Have you received a SOC yet? Remember..if you got a SOC and did NOT file an I9 within 60 days (there are some exceptions) then your claim is considered abandoned.

Did you receive a BVA docket number? If you have not, you still have a very long wait.

If you have received a BVA docket number, then you may get a BVA rating in as little as 2 years..sometimes even less.

If you are like me, it will take your VARO another 35 months to "implement" the Board decision.

So:

1. DRO review..I will guess one more year.

2. DRO hearing..likely 2-3 more years.

3. BVA..with docket number and you returned I9, then you could get your benefits in 3 years or less.

4. BVA with NO docket number and they have not done an SOC, 4to 5 more years.

Bronco, my claim has already been granted by BVA. I was even awarded a rating percentage by the RO. What my appeal is for is I disagreed with the percentage and the effective date. Since my claim is still pending I don't want to give the docket number. Sometimes paranoia gets to me but I just wanted to know what is taking them so long since they have all the evidence they need.

I have noticed sometimes that Jbasser has some great insight into the Louisville RO workings.

Right now Louisville doesn't look to good. 335 days is too long. Did you receive a statement of case from them?

I know Louisville has had some claims from other regional offices sent to them so they may be a little in over their heads.

The best RO. I can say as of today is Huntington West Virginia.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

I know Louisville has had some claims from other regional offices sent to them so they may be a little in over their heads. Wow, they can work other ROs but what about the claims in their area.

I could wrong but if it was me I'd call your RO and ask what the status is on your claim and tell the person you talk with you will hold until they find out.

try not to let them say let us check on that and we will call you back...because usually they don't.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”
