1. If you retire from active duty with 20 + years of military service, can you receive VA disability and Military retirement?

Or do you have to choose from the highest paying compensation ?

2. Can you work if you are 100% service connected ?

You can work if you are 100% Schedular, but the VA can always come after you. If you are IU, you definitely cant work. Only you can decide what is right for you and your family. Good luck and God Bles

Here's what I know, Fat. My father retired in 1992, after 24 years, starting with a field trip to some backwoods South East Asian country. About a year after he retired his VA comp started up at 70%. But was later reduced to 60 by the VA, apparantly they had made an error, or so they said. At that time the concurrent recept issue was in effect, so he was losing a large chunk of his VA to comp for his retirement. I believe now he is receiving the full 100% of his VA, since they corrected the concurrent recept penalty.

As for working as a 100% SCD Vet, my twin brother was until he got hurt on the job. He is now receiving SSD in addition to his VA comp. He can physically do sit down jobs only.

You can work if you are 100% Schedular, but the VA can always come after you. If you are IU, you definitely cant work. Only you can decide what is right for you and your family. Good luck and God Bless

Yes, you can can collect both. Need a min of 50% heres a link to dfas http://www.dfas.mil/retiredmilitary/disability/comparison.html

100% schedular and PnT you can work, IU you cannot. A friend of mine just got his 100%sc PnT and works FT at VAMC.

Fat, I am retired with 22 years active. I am receiving VA disability and Military retirement. So yes you can receive both. Can't answer your second question.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)

    • Are all military medical records on file at the VA?

      RichardZ posted a topic in How to's on filing a Claim,

      I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.
