Reconsideration

Got my denial letter last week, they listed several reports they obtained from my doctors as evidence used to make their determination. They did not list the 657 pages of medical records I sent in with my self report. They also do not know about the following hospitalizations

SEP21-22 IN PATIENT CARDIAC/PANIC ATTACK/STRESS TEST

OCT 4-6 HOSPITALIZED HEART CATHERIZATION

OCT 7-15 PYSCH WARD ANN ARBOR VAMC

OCT 26-31 PYSCH WARD ANN ARBOR VAMC

10/31 - 11/01 HOSPITALIZED ST JOES ANN ARBOR CARDIAC

Does anyone have knowledge about immediate reconsiderations?

I had a appointment with a lawyer yesterday, he wasnt on the ball, seemed uninformed about allot, I didnt hire him, he refered me to another local attorney who specializes in SSDI and I have a appointment next week, I am tired of fighting with the VA and dont have the mental capacity to engage in a second battle with the SSA so I am going to hire a lawyer, I wont miss the 25% of the back pay they will charge me. But back to my original question

Reconsideration????

I sure would ask for a reconsideration based on those new hospital records.

I think they have a Reconsideration form they can send to you.

I am curious Jim-

does the SSA, when they deny a claim, prepare a statement as to exactly why the claim failed-like the VA does?

Is there a time limit on the reconsideration request? I forget.

We filed a reconsideration request many years ago as the SSA failed to address Rod's PTSD records.It took about three months. They had already awarded SSA for his CVA but their regs said they would consider all disabilities and they only considered his CVA.A SSA lawyer would not handle the Recon request-

I called the lawyer up after Rod got a new award letter with retro and told him he just lost over 4 thousand bucks. The lawyer was surprised but I reminded him at out meeting he didnt want to see any of the med recs or any additional evidence. We had a long talk. He really did not realise that veterans with PTSD do get SSA for it- and that it can completely disable someone with it. I hope he began giving PTSD vets more consideration in SSA claims than he did before.

Dont be discouraged if an attorney turns you down.Try to find another one or go it alone- as we did.

It helped me a lot to go to the SSA office and find their regs and criteria on specific disabilities.They have legal books on SSA that they did allow me to read there and make xeroxes from.

I think the PTSD regs were listed under anxiety disorders and we had more than enough evidence to support a SSA PTSD award-based on their regs.

I prepared the reconsideration request just like it was a VA claim,referring to their regs and then stating the pertinent medical evidence and then attaching copies of it all -highlighted.

The award for PTSD took less time to come then the CVA award did.

Jim as Berta says, Take copies of your latest Medical issues and a request for recondideration form.

The Attorney will fill it out. Be sure to take a copy of the denial Letter with you.

You really have to stay on top of the SSA. If you can get an IME from an Occupationsl Specialist. If not Ask the VA for an Evaluation by a Voc Rehab Specialist.

Berta, I received a Denial Letter from SSA that stated: Dear Sir, We deny your due to the fact you can do other Jobs. We realize you cannot do any of your past work. Then it goes into their tunnel vision facts. I took it as this. Dear Sir, Even though you are standing behing the bucklet with your leg Cocked and are getting ready to move your foot forward, You are still breathing and therefore you surely to god must be able to do some Kind of Work.

FLHRCI,

You have 60 days from the day you get the denial letter to file a reconsideration. They usually allow 5 days for delivery from date on letter but I would not push the letter date. They will not list the number of pages in your records, usually just the date of report and who from. If you feel they do not have any reports send them in. Ask them to look at your disibilities as a whole and how it affects your daily activities. List all medications and their side affect. The ailment can affect your body but the medication can affect they are aware of all your limitations. They try to say most times you can do sedary work. Let them know if your concentation lapses or you have a hard time holding attention and forget simple thibgs like can't remember instructions. Did they examine you with their docter? If so state that your own Doctors report should care more weight than a one time eximation.

Usually a lawyer won't take your case unitl the 2nd denial or before you go to the Admin Law Judge.

Let them know everything about how you feel and your limitations. Thats the only way they will know.

That's how I did mine and it worked for me.
