What Does "case Review" Mean?

Rate this question

Question

I filed an FDC Jan 2015 in Winston-Salem NC, shortly after I received a letter that it was converted into a normal claim for some reason. I was surprised by this since I had given them everything they needed, and I just had a C&P for another claim a few months ago that was finalized. The estimated completion date for my new claim was September 2015, all was fine.

7 months later....... for two days out of this week, my claim made it to preparation for decision, but it has since gone back to gathering of evidence. I chatted with Peggy and was told "It shows it is a case review, which means that team needed to look at or correct something." Now the estimated completion date is November 2016 LOL!

I'm guessing that since the preparation for decision phase it when a rater recommends a decision, that if it went back to gathering evidence, maybe the person who signs off on it saw an error or something? What does "case review" mean?

Thanx.

Thank you for your service!

I am in the same boat. Just had a C&P in July, and have had continuous treatment from the VA on the issues claimed and not had C&P's for. I'm still Gathering Evidence today. I hope you are close to getting some good news!

Others have reported that often when the VA doesn't request C&P's, this is a sign of denial. Of-course C&P's are not ALWAYS needed, but normally they are. I'm hoping the since my case was a case review, maybe someone is really looking into the case and not just stamping DENY to get my claim out of the backlog :P I would like to be an example of an IU claim without C&P success story, we'll see...i'll be sure to update as soon as I get the results.

SemperAye,

Not trying to hijack, but we are going through a similar case. I wanted to let you know my ebene. changed to Prep. for Decision today and states "Accepted". However, it says "Requested Documents are Past Due", but when I click the date link for the claim, it shows no pending documents requested, and nothing needed from me. Very confused. Watching your status, because I am hoping it is good news. :)

SemperAye,

Just wanted you to know I posted in the "success" forum. I found out today I am rated 60%, with two contentions (the ones I added after my C&P, GERD and IC) still deferred.  Not seeing any information on retro yet, but wanted to let you know. I hope you have gotten good news and haven't got back to let us know yet. :) Keeping my fingers crossed for you.

SemperAye,

It's a possibility that when you ''Re open'' the IU claim in Jan,& also Requested  Reconsideration on another condition that put a stop to your original FDC claim and  your claim now is seen as a traditional claim!

This could be why the rater called you  and ask to drop the IU?

The VA can go back and look and see what all you have claims for  and its there duty to assist the higher conditions as to the the degree and what it should be rated for % wise  if the % is high enough to warrant a IU rarting they there suppose to rate that and also count all your other contentions  to possibly rate you at a higher level  for SMC's or inferred to SMC's

This is of course the conditions  keeps you from finding gainful employment.

So when you Re-Open the IU claim and ask for Reconsideration on another contention to possibly rate you at 70%....this knock out your FDC claim and now your claim /claims are back to the traditional claims process.

If you get your decision in the next weeks or month or so  if you don't agree   File your NOD.

jmo.
