I went to the DAV office yesterday Ask  to File a PTSD Claim...all he did wa shave me to sign a POA or some form me allowing them to be my repersentive.

He put my name and social on the form 21-526ez and stated  I am fileing  for PTSD Compensation   had me to sign it  that was all

dated  and he said he will mail it to my RO...I ask him if that was the correct place to send it  and are we sending it in with out any information as to who diagnosed me or any medical evidence to support my claim...I said I was told I need to send the PTSD Claim to The Janesville Wi  VA Claim intake Center..he said  by send it to the RO it gets seen faster  I mention the claim centers digitized them on CD & sends them back to the RO he said so does the RO.. He also said it will take about a year for them to order all your records and after they get them in  usually 12 months   Then The VA will send me the thing I need to support my claim.

I wanted to submit my claim with some evidence With VA Progress Notes from myhealthvet from MH  but oh well?

What concerned me was he never put any thing down about my Diagnoses of PTSD down?

Anyway he sent it in to my RO here in Texas   Waco Tx

...my question is  

should I fire this DAV Service Officer   with over 40 years experience in VA Claims? This was  done on 10 -15-15

Not all service officers are equal. Some better than others.   I knew more than the one that "handled" my last claim- example, I had to show him where Agent Orange presumptive deceases were listed.

suggest go back to the DAV and see the senior SO and/or ask to talk to the chapter president

I just want to give you an example of a similar but slightly different experience.  I filed for "foot condition, bilateral, to include plantar fasciitis.  It was written up exactly like that, by my VAMC benefits counselor.  No more no less.  I mailed my evidence packet w/statement in support of claim form to the intake center in Newnan, GA. End result...30% for bilateral pes cavus w/plantar fasciitis. 

So, I would say, build your evidence package, write up your supporting claim letter and mail it off to Packer land!(Janesville, WI).  Oh, and don't forget to get green signature card also.

I had thought of doing that  but now don't everything need to go through the DAV? Do I need to let them see what all evidence and Statement of support letter I send...I can't get no help with the VA Doc's

I may try to find a private psychiatrist that will give me a good nexus letter and examination report, but those are expensive to get  but I'm thinking its my only hope.

I didn't want to file FDC because I will need to present more evidence if I get denied, actually this claim for PTSD is not a FDC

Seems to me the MH was going to help me  there the ones that diagnosed me  but since I mention I was filing a claim for PTSD. They all seem distant and never mentions anything about a claim or wanting to help me with or anything.

I am in therapist treatment at this time  I been seeing a LCSW ( Linsens clinical socail worker) for the last 4 months once a week

He won't help me either  he said since I was already TDIU P&T veterans can't go any higher than that

 

My VA PCP said that she can't write me a letter  '' its not what I do''   she said after I file a claim for PTSD the VA Will send me to a C&P and the examiner will write his/her impression of my PTSD...I ask her if they would write  its likely as not this veterans PTSD Caused by his in the military service while  in Vietnam.''..she said yes thats what they are supposed to do  and check my medical records and my symptoms from what MH as in my Notes

Do C&P examiners do this?

I wanted to get this PTSD  SC at the least!

I will send in my letter to support my claim as to what happen things I witnessed and explain my side of the story  that's all I can do  other than Medical records  but during my service I was never treated for PTSD  ...this came up years later after I got out.

I just recently decided to get help  through my spouse and my PCP  She is the one who sent me to MH

 

I have my c-file requested and my records from NRPC in St Louis  but so for nothing has came in yet.

I have my stressor's and what I was assign to do in Vietnam  I hope my records reflect that.

 I  have my unit name and CO's Name and rank  and my reporting officer in charge.

and other records if they need them to support my claim.

I hope when I get my service records in this will all be easier !

Buck,

I signed POA rights to DAV, back in March of this year.  So far they have done...nada, zilch, nothing, no way, no how, zero to help me.  I specifically asked for help with filing two claims.  They told me I need to get a IMO first, then they would see what they could do. 

The one claim is for a secondary SCD and is currently waiting for C&P to be scheduled.  The other was for my back for increase, which I did wholly on my own,(thanks DAV) and was bumped from 10 to 40%.  I began this year at 40% and doubled up with out the DAV lifting one finger for me.

The only thing that happens is when I receive any correspondence from the VA, the DAV gets a copy as well.  The DAV has not initiated contact with me for anything.  They do respond if and when I contact them first.  I don't know what I expected them to do, really, but certainly I was expecting more than what they haven't done so far.

I sent my evidence package to my claims intake center in Newnan, GA.  From what I have gathered just by being a member here, is trust VSOs as far as you can throw them.  If you want you can make 2 copies of your package and send one to DAV and the other to the intake center.

So, in my humble opinion, send your evidence package directly to your claims intake center in Janesville.

Hopefully your C-file will come soon.  If it's been more than 30 days, send an inquiry via IRIS using the complaint option.  That may light some fire under your request.

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
