BVA just keeps up the Delays

Question

So when I called today apparently they are just sending me a letter that states we are trying to withdrawal your request for a hearing. It was faxed in on the Feb 8 and my motion to advance was granted and the VA sent me a letter dated on the Feb. 26. But today apparently they are just sending me a letter saying they're are working on fixing why it still says in their computer that they're still trying to schedule a central office hearing. Expedited they tell me nothing takes to months to withdrawal a request when no hearing was every scheduled. They will take so long they are going to schedule a hearing take even longer with my appeal say it was my fault they now have to cancel it even though they had the request months before it was scheduled. Who can help with this matter? I am so furious for the past week it was they are waiting to pick it up to review.

Sorry I am not following what you are saying?  Can you be a bit more clearer on your post and what you are trying to do?

As long as you have submitted an NOD your fine.

Just wait until you get that letter from VA of there explanation as why they.

just make sure your NOD DON'T RUN OUT& Make sure you get that letter of explanation.

Am I correct, your at the BVA, represented by a VA Accredited Appeals Attorney who has rrequested that your RO BVA Hearing be cancelled and moved to DC, right so far?

If the above is close to being accurate, what more can you really do? That's what the Lawyer gets his 20% of your Retro for. I have to ask, what does your Lawyer give you as a Guestamit on future Time-line?

You were, 100% down with your Attorney cancelling the Local BVA Hearing, what type of Hearing was initially Scheduled and by whom, you or the attorney?

On occasion, an attorney's motive for changing an imminent Hearing, could be considered somewhat suspect.

Impossible to tell you, to kick back and relax, I know. However, really what can you do now? Even if you had the BVA DC Hearing tomorrow, do you really expect an Award/Denial Remand the following week?

Sorry for the typo. I had a orginally requested a central office hearing in my NOD. Jan 10 appeal was certified to the board, Feb. 10 motion to advance on the docket, and on the 26th it was granted. On March 8 after a Nova conference with my attorney it was unanimously agreed with everyone in the conference it would benefit me to withdrawal my hearing request because one we had a transribed DRO hearing and second once the judge sees the facts he will see how they were bound by my service departments Formal LOD hearing. So he faxed it in where they processed it on the 9th. When I call the case management number for an undate they tell me there is something wrong with their computer because it still says they are trying to schedule a hearing and they have the withdrawal and the granted motion to advance/expedite my appeal. But to be not worried because they sent me a letter stating just that and that they are working on my appeal. Sorry guys my anxiety is getting the better of me I am trying not to think about my appeal its just this tick that won't go away in the back of my head.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
