Vba form 21-0781

Question

Im new to the forum but, I've been soaking up as much info as possible through this site in the past 4 months.  I was told by the VA that I should resubmit my form 21-0781.  My claim is awaiting Dro review.  My question is how would this affect my claim?

Need  little more information?

How long has it been since you sent in the request for DRO?

You can call and ask to check the status of your DRO Request.

Ask if any time line yet?

This will not slow your claim down.

Thanks for the response!  I submitted my nod in November 2015.  I was told the average wait time at the 392 days at the Atlant Regional office.

 

I usually call once a month to check the status.

Well maybe it will be some time this year? or early 2017, you should be gathering up all the records/c-file and evidence you can while you wait.

   Make you a binder and place all the records (favorable) in good order and number the pages, make you a top sheet detailing the subject and dates with the numbered pages so you can find them fast while at your DRO Review,,, go there looking sharp and all your ducks in a row so-to-speak...remember good probative evidence always wins...they just have to read it  and at a C&P Exam or DRO Review this is your chance to make damn sure they do.

Always be honest and your able to back up anything you say  with your records &try your best to get your claim adjudicated at your RO -DRO Review.

  After a DRO Review or Hearing   if your still denied  then its BVA /CAVC time and the waiting time is usually 2 to 4 years or longer.

First off, Welcome!  This site is a wealth of information.....  here are my questions:

1.  Are you currently being treated for PTSD? If so, at the VA? When were you diagnosed for PTSD? 

2. Do you have "in-service" medical records to substantiate the PTSD rating?

3. Why were you originally denied PTSD?  Do you have the decision letter?  If so, please state WORD for WORD the denial

4.  When you filed your NOD, did you request a DRO review hearing in the NOD?  If not, you may not have a "face to face" hearing

5.  In your original claim, did you have a C&P exam for the PTSD?  If so, redact your information and post for us here to review

The 21-0781 is your statement in regard to a "stressor" for PTSD.  Did you serve in "combat" in a foreign country?  If so, your "stressor" for PTSD is presumed.  

I smell a rat here.  Why would you need to "RE submit a 21-0781"?   Did the VA just admit they lost the first one or shredded it?  

Another possibility is that they are trying to catch you in a lie, by saying something different on the second 21-0781 than on the first one.  (After a year or so, we forget things, and we dont always tell "what happened" in an event the same way each time.  This does not mean the event never happened, it just may well mean we forgot some of what we said a year ago.  Heck I forgot what I had for breakfast yesterday, but that does not mean it never happened.    Maybe if you asked me yesterday, I would have said, "Eggs, toast coffee and OJ".   However, today I may just say "eggs and toast" forgetting I had OJ, and not mention coffee as I have that every morning.  If I "changed my story" about breakfast, that does not mean I lied the first time, it could mean that I forgot about the OJ on the second day, and did not mention the coffee as I always drink coffee.  Expect the VA to say you lied, tho, as you changed your story.   Also, yesterday I may have remembered it was BURNT toast.  However, since I dont like burnt toast very well, I may have made some more toast, and maybe I did not think remaking the toast was all that important so I didnt even bother remembering it today.  

I recommend you request a copy of your cfile, if you do NOT have a copy of your old 21-0781.  Read what you said.  It may jog your memory.  This seems like a trap to me.

Its not against the regulations for you to send an IRIS email asking as to why the VARO needs the form resubmitted.  I would ask them if they lost it, and ask them what else they lost if they lost that.  

I would really like to hear their written response as to why you need to RE sumbit  the form.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
