Question

I am trying to figure out if I am getting backpay and how much. Can anyone who's good at math help me out? I appreciate it. I tried figuring it out myself and it came to 26k but I am not sure if I even did it right.

$541 sept 1 2009

$770. oct 1 2011

$797 dec 1 2011

$810 Dec 2012

$822 de 2013

$836 dec 2014

$917 nov 1 2015

$976 Jan 2016

$917 Mar 2020

You can expect payment the first month following your effective date.

What we decided is open reduction fracture which is currently 10% disabling is increased to 20% effective from Aug 2009. Also the 10% knee strain effective date is granted to august 2009

Your overall rating is 50%

I was at 10% for years then up to 20% for a few more years and been at 40% for the last few yrs. Do you need more info? What does all this mean in laymans terms?

Thanks for your time and input.

I am writing my memoirs and would love it if you could help a shipmate out and look at it.

I've had a few challenges, perhaps the same as you. I relate them here to demonstrate that we can learn, overcome, and find purpose in life.

The stories can be harrowing to read; they were challenging to live. Remember that each story taught me something I would need once I found my purpose, and my purpose was and is HadIt.com Veterans.

I can't figure out what your asking with all those benefits that were paid?

only thing I can figure out is find out what 20% compensation is and figure that back to 2009...that's what it looks like to me you will be paid retro on the two 10% increases. from 2009 to date.

20%rate paid at the 255  per month for 6 years is 18.360 plus an extra 8 month 255 would ba additional 2040

18.360 plus 2040 =20400 bucks

The additional 8 months are for the Sept 2009 to Dec 2009   AND THIS YEAR 2016 Jan through April  figured at 255 per month.

The only thing is I am useing the 2013 pay rates...I'm not sure what the 20%pay rate is up to date.

So don't take this as the Gospel ...Its just what I figured from the 255 from Aug 2009  til April 2016

And I could be all wrong about my figures  I just did this in my head.

And I have a bad Headache Now  eh!

just kidding

Hi, thanks for responding. What I am asking is what will the back pay be. I dont understand why they included all these different rates of pay in this letter but I do know that one disability was increased by 10% from aug 2009 to present and the other was granted an effective date of aug 2009 so I guess 20% for 6 yrs sounds right. There was just so many different numbers I didnt know how to make heads or tails of it. Thanks!

Also is there a website or place I can call to see when I will get it?

Cavscout1967,  you can go to ebenefits and submit an Iris inquiry(look under "contact us", then ask a question), or you can call 1-800-827-1000. Congratulations

Im a math whiz, but I would be doing you a disservice to do this for you.  The simplest method for you to calculate this is to put these numbers in a spread sheet, and let the computer add it up for you.

.  If you learn some simple spreadsheet tasks, then people wont be able to dupe you as easily, and you will have more confidence.    I have included a link how to do this with Libre Office, which is a free program you can download.  You can get the software, free, here:    https://www.libreoffice.org/download/libreoffice-fresh/

This utube explains how to add column's.

If you dont want to watch the video, then,   you type the numbers you want to add in a "cell"

and then click "E" .  ( "Sum" is the symbol "Episilon" which looks like a capital "E", but not exactly.  )  and enter.

 https://help.libreoffice.org/Calc/Sum

There are other open source (free) software spreadsheets and many of them are good.  "Open Office"

is well known.  I like Libre office better because its takes less space on my computer than open office.

Open Office is here:

http://www.openoffice.org/download/

Or, you can "buy" MS Office and use the program "Excel".  Microsoft will likely have a tutorial for you for excel.

I think you may have hit on a great idea, for hadit, tho.  Maybe I should, or someone with more spreadsheet experience, should develop a simple tutorial to download, install, and use some software to quickly calculate your retro to see if VA is hornswaggling you on this.  Is there a hadit member who is very familiar with spreadsheets willing to do this??

I could "get by" but am not a spreadsheet expert by any means.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • Do the sct codes help or hurt my disability rating
    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
