SSDI Review

Question

I received the paperwork for Social Security a month or so ago saying that my case was up for review.  It had some paperwork to fill out, etc.  I filled it out and also enclosed my 100% IU permanent and total letter when mailing it back.  Yesterday I received a letter back saying that they weren't reviewing my case at this time and that I need to notify social security if anything changes.  I have never had any doctor or medical appointment for my SSDI, just my VA records.  Do I just sit back and wait for them to decide to review or does this mean they will look at it again in 3 years?

My advice is go see a very good SS disability attorney, SS doesnt work like the VA.  It has nothing to do with the day you file, but the day they find you disabled so (which there is a maximum period of time they will backpay you for but it will be substantial if you win) so the 6k the attorney gets, is nothing and you do zero work and zero stress.  Just hire a very good one that knows what they are doing.

Can a veteran claim SSDI if he turned 65 but was denied the SSDI even though he is 100% VA?  he filed for it years ago when he won his VA.

In other words a vet that  had won his VA & approved for 100% but denied SSDI b/c  SSDI said his disability did not meet the SSA Criteria.

He had sent in all his Dr's Reports that stated he could no longer work and had other documentations in his favor. along with all his Award letters from VA

I just let him know that back then the SSA did not approve soley on VA Awards like they do now  b/c the SSA Has more strick guidelines  your either disable completely or they will not approve.

This was 14 years ago, the vet kept appeals going  and was denied at  the SSA Judge  so the Vet stopped appeals,so actually its been about 12/13 years ago he last filed for SS

I was wondering if he could reopen his SSA Case? or is this something to he needs to ask an SS attorney about?

Even if the vet had no work credits  he still should been approved for the basic SSDI  600.00 I Think?

I always wonder that, I don't know the answer to that and I hope that those veterans that got screwed out of SSDI don't get screwed again at age 65!

Best advice is to make sure all your VA doctor specialists are on board and back you up, also make sure that they write everything they discuss with you in your record. Check you record on ebene's and make sure all doctors are doing there job because a majority of them will cut and paste things "from older appointments" discussed with you, which is redundant and counter intuitive and ultimately will impact you.

If you're 100% P&T I recommend logging onto Ebenefits.  From there go to VA letters and print off your letter stating TDIU.  Submit this letter to the SSA and you're Golden.  It worked out well for me.  I hope you get the same results.  Good luck.
