IME and Physician conflict of interest

Question

Instead of continuing a thread that dealt with CUE and beating a dead horse I thought it wise to start a new thread.

In the pursuit trying to fixed my messed up claim I finally have found a physician that does IMEs

Here is how he responded to my email explaining my situation:

"I read your email. It does sound like you could use some assistance. 

A bit about myself. I do perform IMEs for civilian cases but I am also employed by a company that is contracted by the VA to perform similar disability assessments. I will have to check with my employer to see if your case presents a conflict of interest."

Of, all the flipping luck!!!

I responded and explained further my situation.

Hopefully he responds soon.

That said, I need any advice possible on what I should do next.  I know this could be a blessing or this could be a curse, I don't know which...

OJ, thanks for the Award posting and further explanations. Helps decipher your situation.

Start the SA, or any other DX'd condition FDC on your E-Ben site, you establish the file date for Retro purposes and have up to 12 months to hit the send key. If , for whatever reason you don't hit the send button within the 12 months, the claim goes away.

Buck: I've never seen an actual VA Sleep Dr, not have I seen 1 for a SA DBQ. My SA SC, as well as the other (2) Hadit members, was based on the Clinician Notes from my Private Non VA Sleep Neurologist. The Vet's I deal with at the Det RO, to a man, have been unable to get SA DBQ's completed by the Head Dr of the Sleep Dept. They get refered to their PCP for the SA DBQ. Never put off starting a claim, establish the file date. You've got the 12 months to fine tune it or cancel it.

I don't think any of the Vets have pushed the issue with the Sleep Dr, I would have, they didn't. So they get a DBQ from a non Sleep Specialist, none of them have been able to get the SA SC. 1 guy that's on appeal, has decided to see my Private Dr, see what he thinks about the PTSD Nexus. Have to see how that goes.

Wish you folks good luck.  The VA denial scam can only go for so long before proper medical rationale kills the junk science and BS denials.

I know this is the VA we are talking about they would send a Vulcan into an epileptic fit, probably would be considered inhuman and cruel punishment to even let one within 500 feet of a Vulcan.

What logic?

Anyway, It's likely that the VA's interests were best followed by just picking the next available C&P slot, regardless of other consideration.

Though I have one question about one disability and it relates to Meniere's syndrome. How does one go about diagnosing it?

Ignorance is bliss, when I started learning all the stuff need for tinnitus (which I am now rated for) I read about it.   Unfortunately, back in 1996 while my college friends (they were so young back then compared to me) where playing these first person shooting games I noticed I would get vertigo just watching them play.  I just thought it was one of those things that affected some people and I was just one of the unlucky ones.  I didn't know it was actually a disease.  Now 20+ years later I am finding myself being "dizzy" and "woozy" more than I think I should be.

I am sure some of it could be that I got up to quick, but 5 to 10 minutes after getting up?  Or when you are sitting down?  I have some other stuff that could be playing a fact too, take blood pressure meds, not that my BP is all that bad.

I take meds for my ADHD (amphetamines) which I know can mess with blood pressure (so I limit taking that only on days I work).

Where do I even start so I don't wind up in the same mess that I am currently in with my other claim?

IME Physician cannot see me, said that I don't fall into the area of expertise that he deals with...

And that he was going to be gone the last two weeks in June...

On the plus note I asked if it was something with my records, or if it was that they didn't think I had a chance.  His secretary said no, that actually that the information I had provided was quite thorough and that they don't usually get that much information.

I asked if she could get me a name of someone that could help me and she said that she would call him and probably would get back to me later today.

I hope this isn't a case of them just politely giving me the brush off.  She seemed sincere about being apologetic and apologized many times.  I just repeatedly tried to drive home that if they couldn't do it then PLEASE give me a contact of someone that could.

The next closest SNEAK certified physician is in St. Louis that I know of (from the SNEAK website).
