Is it me or is my claim moving really fast?

Question

So I just filed for benefits on 05/07/2016, my last C&P was on 6/15/16. Monday my application was approved and changed to preparation for decision, and my completion estimate date moved up to 07/15/2016 - 08/17/2016.  Is it me or is this going faster than I thought, I did wait until the last minute to file, I first filed a month away from my 1 year separation date. So around 11 months separated, i'm guessing it had something to do with that. As far as the estimated time, would it be closer to the 07/15, or the 8/17?

What in your view is "Clear Evidence," sometimes doesn't carry the day.

What we do know, with a certain degree confidence, RETRO $$ generally hit your Direct Deposit account at least 2-4 weeks before you actually receive the Award/Denial Letter. Recently, E-Ben has actually had Award Letters available up to 4 mos before the actual Award Letter arrives.

My recent 12/14 Quality Review Award, was posted on my E-Ben account 01/03/16, the Retro Hit mid to end of 01/16. Award Letter didn't arrive til mid 04/16.

If you filed an FDC, and VA has no reason to move your FDC to a Reg Axx Claim (needing additional Evidence), you should expect a Decision in 4 to 6 months as opposed to 12 - 18 months for the Reg Axx claim Decision.

Let us know how the "Clear Evidence" deal worked out .If you have an opportunity, post a redacted copy of your "Clear Evidence."

Hey man,

My claim moved rather quickly as well. Just around 90 days. Mine went through Austin MHV. Not sure what MHV means. 

So I claimed a bunch of things over 10+ and an increase. Had 3 C and P exams and I was approved for the increase but denied for everything else. So it could very well be a toss up of any number of things. I hope you get what your looking for.

Gastone, thanks for your reply. I'm not sure what nor how to post a redacted copy. I have no problem with it. Does the VA review this site and would it be harmful?

What I meant by easy is that I applied for SC sleep apnea. Two years prior to retirement I was diagnosed with possible SA. I was referred to a sleep study that diagnosed me with mild obstructive sleep apnea and recommended CPAP and surgery on my uvula. I submitted the sleep study and medical records. I was recently diagnosed and substantiated by Tricare referral sleep study of very sever OSA and I have been using a CPAP. Based on all I've read here and learned elsewhere, this is a clear case. Yet, I have heard nothing except gathering evidence. In fact, this whole week, I have been unable to get any status (error message) from e-benefits. I am in the San Diego area and the VFW is my VSO and they do not respond to any query. 

I'm sure that I'm in a waiting situation. I can wait and not check regularly, but I'm also told that if I miss an appointment for a C&P exam, I start over. Everyone says this is the way things are done with the VA. However, that's never been a very good excuse. 

It's nice to see that others get more timely service though.

Now that's an informative post. I see a SA SC of 50% being a lock. You in service DX and Treatment to include use of CPAP, is the Deal Maker.

If at anytime in the future, you get a DX of Pulmonary Hypertension, or get a DX of a periodic Low Pulse 02 (below 90%), requiring supplemental 02 with your CPAP, be prepared to file an FDC for Secondaries to your SA and an increase to 100% for your SA.

As for Redacted, just black out your identifying info and scan as a Pdf to attach to your posts. The more info we have, the easier and less time consuming the help process can be.

Was this claim, an FDC?

How does this process work exactly, I see people talking about they got denied a lot. If I'm under a year out, and I file for a psych issue, and I received a very favorable C&P with an inservice event that almost cost me my life with the military hospital staff at fault, all evidence points to that being the cause of my psych issue, I also went to anxiety management groups in bootcamp, how can they deny S/C? The only issue I can think of is on my exit exam I said I didn't have psych issues, I was just ready to leave a that point. For tinnitus, I told her I had ringing in both ears, but I could only hear it in a quiet room, could they deny that?

Denials are a fact of life, with regards to VA Comp Claims.

Quite often, Denials are the result of poor or improper presentation or lack thereof, of the necessary Medical Evidence supporting the Claim.  This is usually the fault of an inexperienced Vet or more often than not, a New or old VSO-Rep, just going through the motions of filing the claim.

You'll hear from many Denied Vet's about the VA Conspiracy to issue Denials. Really, a nation wide "Secret" conspiracy by GS-12 and lower Government Employees to issue Denials? Keep in mind, we're talking about Govt Employees here, not the Mafia.

If your on a FDC, you'll know very soon, regarding your SC Awards & Denials. Don't get caught up in the "What If's" about your claim. Deal with the "What Is," after you receive the actual Award/Denial letter.

How far are you from your VARO? Might be time to make a visit to your VSO's main office at your RO and have a set down with the MFIC, regarding communication problems with your VSO-Rep.

Continuity of follow-up and ease of contacting your Rep is very important. If your current VSO doesn't measure up, jump ship, sooner rather than later. Check out the other RO VSOs and their Staffing situation while your at the RO. Finding a well seasoned VSO-Rep is a very difficult task, trial & error is all you have.

Many Vets have been successful handling their own claims, using VSO's only for info and DRO & BVA Hearing Representation.
