Yep, that's right the Veterans Omnibus Bill passed in the last hours of 109th congress. I guess all that is left, if for the President to sign it.

Well it is about time. Interesting how Buyers tries to take credit for a lot of things in the bill. One good thing is we don't have to worry about Buyers, or Craig anymore. I think veterans will start to get a better shake now.

The bill includes an historic provision allowing veterans to hire an agent or attorney to represent them after a notice of disagreement has been filed. “This will afford veterans with the opportunity to have representation while protecting them from unscrupulous attorneys,” Buyer said. “I will exercise careful oversight of this new authority.”

It's a crying shame they are bragging about giving us "the right" to use counsel for getting what we are supposed to be entitled to?!

Senator Craig, gets in the act, praising Congressman Buyer for squeezing veterans, to the very last moment of their powers as heads of VA committee's.

Greetings to all,

I was thrilled to hear this issue come to law. I believe it will mean a great deal of accountability of the part of the VARO claims process. With the issues I am going through and many here at hadit would not have to loose hours of sleep and anxiety over weather if the VARO will rate their claim lawfully. I believe this law will manidate that we as disabled veterans will may begin to have a voice in a process that is completely broken.

I belive this law will competely shake the Service Origazations to the bone. The days of the good old boys from the AL, DAV, and others haveing lunch with the ratings officers at the VARO offices accross America are over. I am blessed to hear that Bauer and his court of theives are out the door.

I received a letter from a major service origazation which I am a life member it said that having lawyers would mean money out of the pockets of veterans. I do realize this was designed to save face, however any veteran who is, has, or, will go through this porcess will see results now, and not be at thye mercy of incompentent raters, DROs. Maybe even remands will go down a great deal, when the VARO will fineally have to do their jobs correctly and lawfully. Just my thoughts. Merry Christmas to you all. God bless.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.
