Helllo All

               I was hoping someone could help me understand.  On November 11, 2016 it will have been a year since I submitted a NOD DRO review.

I checked ebenefits to see if there are any updates or movement and there are none.  It is completely empty.   Can anyone shed some light as to why this is.  Will it always be this way?

By the way the case is a retro (back pay) I believe they owe me.

Oh by the way I heard by Peggy that the turn around rime was somewhere around 344 days.  Can I believe this date?  Why must itake longer then a year if you have the evidence.

  Thanks for your time and input.  Yes I have my direct deposit, email, and those items you listed in working order.   I just don't know why it's taken them a year now and counting to do a DRO review and they haven't updated Ebenefits. Unless they haven't done anything to my claim yet.  Which is sad.  I have paperwork I gave VA that clearly states that in 2011 I left my job due to a service connected disability and Social Security Disability agreed with the disability.  I was never reimbursed for the disability by VA at the 100% level.  This case should be a no brainer.

May I ask why your case took 4.25 years?  Was it because you were fighting BVA and DRO or was it strictly DRO that took this long?  Did you not have enough evidence the first time or did you have to resubmit?  I'm asking because I sure hope my case won't take that long because I am in need of some revenue.

Anyway thanks for chiming in on post it's appreciated

Strictly my lay opinion now, you screwed the pooch by jumping to the DRO Review, too quickly.

I just went thru the same EED situation 04/15, from a 12/15 Quality Review Award of a 07/15 Denial Decision. If it weren't for a VSO phone conversation about a completely different matter, I'd been climbing on the DRO Review Train myself.

While speaking (mid 04/16) to my VSO DRO Hearing Specialist, that had attended my successful DRO Hearing Award 06/14, in passing I told him about the DRO Review for an EED that I was about to File.

Being that it was early on from the 12/15 Decision, he advised me to file an "Official Request for CUE Review," attaching all the supporting Evidence that was already(Evidence of Record) in my C-File and VMC Med Records. Faxed the Evidence copies to him that afternoon, he filed the "CUE Review Request" the same day.

Showed up on my E-Ben as a New Claim for EED CUE Review, in about 2 weeks.

I had my NOD Requesting the DRO Review, locked & cocked, ready to file in the event nothing came back from the VA by 12/16. BAM, 18 mos of additional SMC-S (1) hit my CU in July at about 1:30 am, Txt hit my phone at 7:30am. DON"T NEED NO STANKIN DRO REVIEW! About 21/2 mos from filing, to Retro Deposit, not too shabby. Award Letter didn't arrive till end of 08/16.

Strictly the DRO Hearing wait time at Det RO. Spent a good portion of 13, trying to track down the exact status of my Hearing Date Schedule, Mission Impossible.

Early 01/14, I even filed an Official Request for an "Informal DRO Evidence conference." Never got the DRO Conference, but did receive (early April) notification of a DRO Hearing scheduled for 06/29/14.

At the DRO Hearing, before the DRO Swore me in, he was discussing what the Hearing was going to cover. I mentioned that I had Filed 01/14 for an "Informal Evidence Conference." He opened his File and pulled out my request. Said if I wanted the Informal Evidence conference, we could have it right then. He also stated that at any time I wanted to stop and go on the record, he would swear me in and start Recording for Transcription. I agreed, he Awarded all $$ Issues from the 10 NOD and said because I went Informal, he was going to address a 12 NOD for IU, Awarded that also. That IU Denial was not scheduled to be addressed.

The fact that he told me what he was Awarding and that I would have a copy of his Award Decision that afternoon, I never addressed the why it took 4.25 yrs for the Hearing.

When I filed the 10 NOD from an 09 Denial that Awarded 10% SC for Tinnitus, I had New Claims in for CAD & SA and then in 11 PTSD. At the time of the Hearing, I had been 90% SC since mid 12 PTSD Award with Inferred IU Denied in late 12, another DRO Hearing Request made same day as Denial.

Some "Experts" advise against filing additional claims when you have claims or appeals pending. I certainly don't agree, even if it added time to my Hearing, the additional claims certainly added to my RETRO. If you get a DX that could be a Direct or Secondary SC, File the Claim.

So am I looking at 5yrs for a EED decision or will they start looking now into my EED.   It's been a year. And there is only a few documents for them to look at.  My case is in Detroit.

If you filed in or around 2011 and sent them the info as to the SSDI award (and if they in turn contacted the SSA)and if you, since that time, consistently pursued the same claim, you could  be possibly looking at a very favorable EED. I assume the paperwork you sent in also regarded the 21-8940 TDIU form....

You are at 100% now....do you expect a SMC S award?
