Question

Question related to below issue:  Does it take another 10 years to have these benefits available in the event of death.

Seems like an easy issue, however we are a little confused..

  • Vietnam Veteran finally awarded 100% P&T (PTSD) in 2014 with settlement going back to Dec 2013 ( Kudos to Hadit for helping us understand what we needed to do)
  • Been married 20 years (m.1997)
  • It took nearly 50 years to receive this rating,...

Does it take another 10 years to have these benefits available in the event of death.

The eligibility criteria for DIC is here:

There is also Section 1151 DIC which is explained in the 1151 forum.

Did they deny you in the past 50 years for PTSD?.... geez...I need to find and read your past posts....

With the P & T your spouse and kids are eligible for CHAMPVA and Chapter 35 educational benefits.

What did they base the Dec 2013 date on for the retro?

Generally, it takes 10 years from your effective date to be eligible for DIC if you die from ANY cause. 

If you die from a SC condition, your spouse need not wait the full 10 years.  To be safe, dont die before your 10 year (effective date) anniversary.
