Question

My current "big name" legal team, seems to have forgotten about my claim and are too busy to return my emails. They've had my C-file for the last 6 months on a slam-dunk PTSD case. Is this a normal experience from those who have gone through this before?

I would appreciate referrals from anyone that's had a positive experience with an Attorney that get my case closed with the VA. Not sure what worse, the stress and effects of PTSD or the relentless grinding trying journey of getting awarded your claim.

Your help is appreciated.

It's just a shame there is a profit motivation for the lawyers to dawdle for years just to make more money!

How else does a private practicing attorney or rep make money? No donations unlike most VSO organizations. I'm open to suggestions. Unless the lawyer is already a multi-millionaire resting on his laurels and does this for fun...profit is exactly a motivating factor for winning. Ergo the contingency fee.

If you asking how else an attorney makes money other than "fraud" (dawdling needlessly for years jacking up the revenues while the vet is starving), then I don't know what to tell you except "EARN your money, and move on!" If you can't do that, you are asking for sympathy in the wrong place.

ID LIKE TO JUST CHIME IN SMALL.. TRY TO SEE IT FROM THERE POINT,,,, NO MONEY IN AN EARLY CASE WON.

NOT TOTALLY SURE HOW VSO'S GET THERE YEARLY MONEY BUT IVE SEEN PAY CHECKS THAT ARE AROUND 60K FIR SOME OF THESE REPS...

ANYWAY,,,,, THE REAL QUESTION IS,,,, IF ALL OF OUR CLAIMS WENT THROUGH A PROCESS OF ONLY 125 DAYS THEN AN APPEAL OF ONLY ANOTHER YEAR AS THE POINT THEY WANT.... HOW WOULD ANY OF THESE VSO:S MAKE MONEY? IF ALL WAS BEING ACCOMPLISHED THEN THEY WOULD BE USELESS?????? ITS CALLED BUREAUCRACY

With the Attorney fees being steep. I chose to go with an IMO/IME. The reason I did this was 1 it was much cheaper, 2 with the hearing while an attorney in a court room is great the weight of a great medical expert works better. Since they are the ones speaking to your medical condition. I used Valor Compensation Consulting. I did not have to go to a hearing but was awarded a reconsideration victory for a sleep apnea. I also believe they have an accredited agent to help with the filing.

I disagree....VA dawdles for years and that is what strings out a claim.I am sure most vet lawyers would rather have the claim resolved and get paid sooner than later. That also would look good on their web site resumes, and they could attract more vets to be their clients.

Vet reps get paid a salary from their Vet orgs or their state /county if they are state or county reps.

That salary gives most vet reps no incentive at all to do a good job.

But I agree with some of the replys above.

Some claims need an independent medical opinion and lawyers cannot write IMOs.Many would advise getting an IMO/IME based on the specific type pf claim

And some claims need bona fide proof of a nexus.....which often rests on the veteran themselves finding and providing VA the proof of the nexus.

I recommend all veterans with claims to go get a IMO/IME  its worth the cost & working your claim yourself over paying for an attorney  these 4 little words '' is likely as not'' is the magic words the VA Likes to read.

Just call around  until you can find a  private Veteran Friendly Doctor that is specialized with your condition, I have called two different Doctors  on occasion with different conditions and I just mention to the office girls what I needed  about a VA Claim I am filing on and need the Doctor to write me  his/her professional opinion & go over some of my medical records I have with me pertinent to my claim and  let the Dr know to use the VA lingo   when making his/her  opinion.

They like it to be  said in a 50/50 way so to speak to word it as in ''Is Likely As Not'' in your statement  this  does not bound the Doctor to anything with the VA.

The VA will use his/her Statement and is not Bound by the VA in anyway, the VA is free to call the Doctor if they need/want to  so what....Dr's are educated highly and Lot more then the general Vet & as for asI  know the VA Don't have a Regulation or Law that prohibits the veteran from seeing a private Doctor/Specialist.

Some Dr's will write an Opinion letter just for an office visit  but its good to get a complete exam blood work ect,,ect,,  usually in one day.

The Dr will write you an opinion./Impression  usually he/she will dictate it into a recording machine and have it transcribe in a few days...You can either go to the Dr office when the letter is ready  or just have them to email/fax it to you.

Its good the Dr puts his/her credentials down  but M.D. works ok too! & the Dr's  Letter Head.
