terry i have read your posts for last 3 years. never joined hadit till now.i agree with that the va acts in bad faith and deinals of 94%OF THE TIME. MY CLAIMS ARE OVER 30 MONTHS OLD WAITING FOR PERSONAL DRO IN WACO TEXAS.THEY LOST MY SMC.EXPECT MORE OF THE SAME.ALSO WILL GET A LAWYER AFTER THE NEXT DEINAL.HAVE SENT IN MANY IMO IN SUPPORT OF MY CLAIMS.AWARDED SOCIAL SECURITY IN 4 MONTHS FOR SERVICE CONNECTED MENTAL DISORDERS OF PTSD ANXEITY AND DEPRESSION.APPLIED FOR IU. STILL WAITING. YOUR FRIEND CHEIF 313

Chief- do you mean you sent them the formal TDIU form 21-8940?

I think you do-

an award from SSA for the same claimed disability -with strong nexus (link) to your service should get you TDIU.

Has the VARO sent you an authorization form in order to obtain your SSA records-

and if they have -have you checked with the SSA and also the VA (you could use the email inquery system) to make sure that SSA got the request and that the VA has received the SSA records?

(they lost your SMRs? service records?---the SSA probably still has a copy of them.)

Have you tried to get them yourself from NARA or SSA?

If I were you I would also double check to make sure they got your TDIU form.

they dont seem to accept the SSA award letter at all-

it is the actual SSA records that they need

berta, texas veterans commision has poa. went to local ss office got a statement from them reads. our records indicate you became entitled to social security disability benefirs effective 10/2006 your disability was approved based on a primary diagnosis of affective/mood disorders and secondary diagnosis of organic mental disorders. my 30% service connected disability is ptsd/mdd .will this serve as a nexus ? berta thanks for help to all veterans. your friend cheif 313

Good Luck Chief it took me 5 years to go through Waco that would include three hearings, 1 BVA remand and several C&P's. I still think that it is best for the Veteran to meet the decider face to face.

Veterans deserve real choice for their health care.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”
