Effective date and retroactive pay

Rate this question

Question

Hi! My husband was increased from 30% to 50%. Under "What We Decided" they changed one of the claims that was initially denied to 0% with an effective date of 10/2010.  Then they increased another claim from 0% to 20% with an effective date of 2/1/2017 (claim was initially filed in 2010 for this and he got 0%..now they agree that his issue worsened). We are are trying to figure out if he would be eligible for backpay at all? Thanks for any info....

I was diagnosed in service and discharged i think beacuse of my condition. but i was not medicaly discharged although I was service connected about 7 years after I was discharged at 10%.   If I get my DIscharge changed to a medical discharge could I get back pay to the day I was Discharged?

Yeah, but it is very difficult to go back and do it.  If you were discharged after 2001 and got less than 30%, there is a board that will review it, but they only review the problems they originally submitted.  I did it and they wouldn't change it, but now I have more ammunition if I get my retroactive VA pay and backdated to when I got off of active duty, then I can hopefully get my disability retirement retroactive....it would be sweet...

No back pay as his conditioned worsened at the time of the last exam not prior to it.  If he would have appealed the decision and won an appeal he would have been eligible for back pay.  That is the way I see it.  They just did the same to me on one of my service connected disabilities.  The increase came during a standard review of my disabilities.

This was my experience, as well. The VA requested an exam 5 years after my initial award for PTSD. The VA determined my condition had worsened and raised my PTSD rating from 50% to 70% which increased my combined by 10%. The entire process only took 2 months and I've never received pay for increased percentage. I just assumed that they went by the date of the re-determination.

You can try looking in ebenefits/vets.gov in the "letters" secition.  Other than that, wait for the envelope.

My claim was approved 03/14/2019, and I was awarded 100% T&P.  However, the decision was a "Partial" decision. The disability for stress was deferred at my request. My claim was filed on 12/03/2018 and has an effective date of 12/01/2018. I have not my BBE as of yet. Should I receive/be awarded back pay?

I filed a claim for hip, ankles, & feet secondary to my service-connected knees in May 28 2010 & was denied. I then filed a NOD on May 27 2011. The appeals went back & forth in two Remands from 2011 to May 2018 when I finally elected to join a Higher level Ramp program. It was denied in Nov 2018. The SOC said I had to Feb 2019 to do either Supplemental Ramp or BVA I chose Supplemental Ramp on 4 Jan 2019. I was awarded 10% for both hips bringing me up from 40% - 50% but my effective date said 25 Feb 2019. When I called the 800 number the clerk said I wouldn't receive any retro pay because of my effective date being 25 Feb 19. Does this sounds accurate? Or do I have a case?
