The adversarial VA

Rate this question

Question

Do you feel that the VA is an advocate for the veteran?  I do not.  I see it as an adversarial relationship. How is it, that a person who has been running from the truth for 25 years from the horror of military sexual trauma, must now go in and try to convince someone who doesn't believe them?  Where is my representation?

I was Sexually assaulted by a LTCDR DOCTOR in the navy.  MY DOCTOR

I'm not going to go dance for scraps in front of someone who's going to do a spot assessment to decide a reward that will ensure my family continues to live in poverty. this ruined my life, it led to a car wreck that killed two people and my radio active decay in the intervening time has soiled every relationship I have. I am completely wrecked, turned inside out.

I'm not going to be quiet, this was the head of the urology department in Kadena Japan.  He bragged about this, I will bet my claim on it that someone in his department new that 'Skip' handled people like me in this fashion.  While i'm confident my case is solid for 100% disability, I know I'm not the only one he did this to.  He was a sexual predator, there are others that may not be able to unravel this, or that lack evidence in their claim.  This is how the military keeps this sh!t under wraps.  If there is a proven case of sexual misconduct from an officer / doctor who was in a position to ruin a lot of people, every single service member who had a DRE from this guy needs to be contacted.

I'm contacting my representative.

I'm not going to stand in line to help perpetuate a broken system.  I understand that is all they offer.  I also understand that 22 service members commit suicide every day.  That says the program is broken.

I am not ashamed of my truth, I'll stand up and blow the doors off of this thing.  The VA is not an advocate for veterans.  As I see it, they are perpetuating the problem and are therefore complicit in it.  I don't want money, I want change.  I want to leave this place better than I found it

The VA's role is damage control.  This fire isnt going to get put out.

There's a whole bunch of rage and anger inside, Im going to channel it into doing some good for people.

This man was an officer in the navy and a doctor and the head of the urology department in Kadena Japan. Im not the only one he did this to. Additionally, I will stake my claim on him bragging to his staff about it.

My circumstances were unique in that I was a time bomb. I had a tremendous amount of un-integrated childhood trauma like a very deep infection, he shoved his hand in there and poked a hole in it.

The ensuing nightmares, and waking panic stripped me of my ability to fly for my remaining time in the service and I made up incessant excuses to get out of it. I could not engage in my previous hobbies due to intense anxiety and my marriage fell apart. It was in this frame of mind that i bought from my friend, the hot rod we used to drive around in during high school. It was a tangible representation of a more stable and happy time in my life.

6 months after getting out I killed two people in a wreck I caused racing it around town.

A year after the accident, I had full recall of being handcuffed and raped by my best friend's uncle when I was 7 years old.  I've spent the intervening time trying to become something to justify it all and have outlived my ability to keep running.

While my claim and support and evidence present an iron clad case for some kind of disability, it's not something I am going to get in front of another VA doctor who doesn't have my best interest in mind and dance for them.  I'll have professional, civilian representation.

Additionally, what of the others this guy ruined? He was a sexual predator (he died in 2014) Every serviceman and woman who was seen by this guy needs to be contacted by the VA proactively.

In any case where a serviceman or woman claimed this guy sexually assaulted them and was denied disability for lack of evidence, the case needs be actively reopened and my evidence submitted in support of their claim. (I have lots)

The VA does not do this. They are not an advocate of the veteran. Their function is damage control, minimization. This wait and see if anyone survives long enough to be able to both understand and provide enough evidence to support their claim is criminal.  How many vets are casualties of this mindset each day? 22?

I am the loudest person I know

I am unwavering when I am in possession of the truth and all of my shame burned up in the fire getting to here.

Stay tuned

So sorry to hear you went through this  Yes I believe the VA is Adversarial, but they are still some good employees in the VA System.

Unfortunately  its the only system we have  to get help medically and financially  speaking.

Most survivors are very unlikely to have any documentation showing that the sexual assault or harassment occurred. There is a significant stigma against reporting such assaults, and because assaults are often are not reported right away, the military has often taken no disciplinary action at all against those who perpetrated these assaults. This often means there is no record at all of what happened.

The VA understands this and does not require that service medical records contain proof of the assault or harassment.

RELATED ADS

Other forms of proof of the incident(s) that will be accepted include:

police records and/or records from rape crisis centers

pregnancy tests or tests for sexually transmitted diseases

statements from your friends in service, family members, counselors, or clergy, or

journals or diaries that you kept at the time of the trauma.

Proof of behavioral changes will also be accepted, such as:

documentation that you requested a transfer

evidence of a drug or alcohol problem

changes in job performance and/or changes in your social or economic behavior for which there is no other explanation

marital and/or sexual difficulties, or

incidents of depression or anxiety for which no other cause has been identified.

How to Apply for Disability Compensation

As a survivor of military sexual trauma, you may be entitled to expedited processing of your disability claim. Check with your  regional office  to see if they have implement VA's Fast Track program, and if they have, apply using  VA Form 21-526EZ.  If the office isn't using Fast Track yet, apply using  VA Form 21-526.  If you have a claim for PTSD based on MST, also complete and submit  VA Form 21-0781a, Statement in Support of Claim for Service Connection for Post-Traumatic Stress Disorder Secondary to Personal Assault.

You can also apply online at  www.ebenefits.va.gov. If you need help with your application, call your  regional VA office  and ask if there is an MST specialist that can help you. Not all regional offices have an MST specialist, so if yours doesn’t, then ask to speak to the Women Veterans Coordinator. To locate your regional office, call 800-827-1000 or visit  www.va.gov.

If you don't want money from the VA that is all they have to offer.   It is like blowing the doors off a whorehouse.  Guess what?  You will find whores inside!  Get the money and forget the rest.
