Dependency claim initiated by VA while compensation claim active/in progress


Question

Good afternoon All and Thank you all for your service!

I do not have any awards as of yet but for those who do how common is it for the VA to initiate/open a dependency claim while your compensation claim is still active? I submitted a FDC on 1/17/2017 and it included the 21-686c for Status of Dependents. Is this a good sign for potential service connection award for those familiar or working at VA?

I was in the USAF Reserves and have been out since May 2012.

There was a suspense date for the dependency claim of 5/2/17, asking for a "rating" (assuming associated with my compensation claim), however my compensation claim is still in the Prep for Decision phase in Ebennies.

Curious to know if this is a good sign that the VA initiated this dependency claim about 90 days into my compensation claim.

      So I am divorced and currently my ex-wife has primary custody and claims our children on taxes. I am awaiting my change from 90-100%, that will allow me to add my children on for CHAMPVA. My question is
      Can I claim my kids as dependents on my VA stuff, if I am not claiming them on my tax returns? Or do me and my ex need to change it so that I claim them as dependents on our taxes in order to claim them as VA dependents.

      I’m 100% P&T and my son’s mom recently passed away. I now have to get him covered with health insurance and do not know how CHAMPVA works. Is it like regular health insurance? I don’t understand the cost sharing thing. Is there a co-pay? Thanks

      I am currently at 20%, I put in for an increase, and because I am an optimistic person I put in for dependents (My wife & kids), I submitted the claim in September of last year..  I checked my claim this afternoon, there happened to be an update.  I was just curious what "Awaiting 020 rating Promulgation" means?  I googled the word Promulgation and get the vibe that my claim may be coming to an end.  Any info?

      Not entirely sure where to post this but here goes, So I am not well versed in the dependent side of the VA, but I am very good at keeping track of my paperwork of what I have received and also sent to the VA.  I currently received a full award from the BVA and am just waiting for my RO to make their judgements on everything. When I first left the service I received my initial award two months later (early Va program). My RO at the time was still Winston-Salem, I received a letter August of 2011 asking for my updated dependency status. At this time I was going through a divorce and in September when it was finalized I sent a copy of my dissolution to the Winston-Salem RO (I have copies of this).  What I did not realize was that I was still being paid at the rate of having a spouse. I sat down with a VSO the other day and he asked how my wife was and while a bit stunned I simply said I haven't been married since 2011. He informed me that they have been paying me at that rate for 7 years. My question is even though I sent this dependency change, Should I have take other action? I did get on ebenefits because the gentleman said I could check it on there and she is listed under (dependents not under award) but I checked my payment history and sure enough I have been getting paid at this rate. What should my next course of action be in this matter? I don't want them to feel as though I was trying to steal from them and I also don't know what I should do. My BVA award letter even mentions multiple times during my C&P exams that my marriage had ended, this alone shows that I was not trying to hide this from them. Should I show them the extra copies that I sent to Winston-Salem? Below is one of the copies of the letter I sent to the RO in Winston-Salem.

      Has anybody else noticed dependents listed as yours - that are not.
      I am not paid for them. I could not have added them, a site administrator added them.
      I voiced concern a few months ago and of course nobody cared.
      I have erroneously listed two minors-  a boy and girl and a 20 yo female. All last names are Martinez.
      I even have two wives !! Take a Look

    • I already get compensation for bladder cancer for Camp Lejeune Water issue, now that it is added to Agent Orange does it mean that the VA should pay me the difference between Camp Lejeune and 1992 when I retired from the Marine Corps or do I have to re-apply for it for Agent Orange, or will the VA look at at current cases already receiving bladder cancer compensation.     • 5,10, 20 Rule
      The 5, 10, 20 year rules...



      Five Year Rule) If you have had the same rating for five or more years, the VA cannot reduce your rating unless your condition has improved on a sustained basis. All the medical evidence, not just the reexamination report, must support the conclusion that your improvement is more than temporary.



      Ten Year Rule) The 10 year rule is after 10 years, the service connection is protected from being dropped.



      Twenty Year Rule) If your disability has been continuously rated at or above a certain rating level for 20 or more years, the VA cannot reduce your rating unless it finds the rating was based on fraud. This is a very high standard and it's unlikely the rating would get reduced.



      If you are 100% for 20 years (Either 100% schedular or 100% TDIU - Total Disability based on Individual Unemployability or IU), you are automatically Permanent & Total (P&T). And, that after 20 years the total disability (100% or IU) is protected from reduction for the remainder of the person's life. "M-21-1-IX.ii.2.1.j. When a P&T Disability Exists"



      At 55, P&T (Permanent & Total) or a few other reasons the VBA will not initiate a review. Here is the graphic below for that. However if the Veteran files a new compensation claim or files for an increase, then it is YOU that initiated to possible review.



      NOTE: Until a percentage is in place for 10 years, the service connection can be removed. After that, the service connection is protected.

      Example for 2020 using the same disability rating



      1998 - Initially Service Connected @ 10%



      RESULT: Service Connection Protected in 2008



      RESULT: 10% Protected from reduction in 2018 (20 years)



      2020 - Service Connection Increased @ 30%



      RESULT: 30% is Protected from reduction in 2040 (20 years)

    • Post in New BVA Grants
      While the BVA has some discretion here, often they "chop up claims".  For example, BVA will order SERVICE CONNECTION, and leave it up to the VARO the disability percent and effective date.  

      I hate that its that way.  The board should "render a decision", to include service connection, disability percentage AND effective date, so we dont have to appeal "each" of those issues over then next 15 years on a hamster wheel.

    • Finally heard back that I received my 100% Overall rating and a 100% PTSD rating Following my long appeal process!

      My question is this, given the fact that my appeal was on the advanced docket and is an “Expedited” appeal, what happens now and how long(ish) is the process from here on out with retro and so forth? I’ve read a million things but nothing with an expedited appeal status.

      Anyone deal with this situation before? My jump is from 50 to 100 over the course of 2 years if that helps some. I only am asking because as happy as I am, I would be much happier to pay some of these bills off!

    • I told reviewer that I had a bad C&P, and that all I wanted was a fair shake, and she even said, that was what she was all ready viewed for herself. The first C&P don't even  reflect my Treatment in the VA PTSD clinic. In my new C&P I was only asked about symptoms, seeing shit, rituals, nightmares, paying bills and about childhood, but didn't ask about details of it. Just about twenty question, and  nothing about stressor,
