got the rating the day after Christmas , got the award in the bank today . The amount received doesn't come to the amount I calculated I should have gotten it is off by a rather large sum. Do I send my questions to the regional office or do I send my questions directly to the finance office? I also received what would be January's check but they did not increase to the new amount which should be in effect. still getting paid at the old percentage. As they have sent both the back pay and paid Januarys check is this another error ?

When you are calculating the retro, are you going by the effective date VA stated in the rating decision? Or are you going by the effective what you thing it should be? If you are calculating the retro from the effective what you think it should be and it's different fromy the VA's, then you should write an NOD to your regional office and state why you think the effective date is incorrect. If you're calculating the retro from the effective date that VA has awarded, are you also figuring any dependents that you may have, but aren't yet added to your compensation? Just some thoughts!

You haven't received January's compensation yet, that happens on February 1, 2007. You always receive your compensation the first day of the month for the previous month. For example, December 2006 compensation is paid on January 1, 2007. So, January 1, 2007, you should receive December's comp with annual increase.

No I am going by the VA dates. and I guess I put it wrong as I should have said DEC check received for January my check is already in the bank that I should recieve on the 1st. The increase to the 100% amount is not on the check I just received but i was still paid at the old rate but the increase in living was applyed to it.

got another question when figuring the retro. I went from 50% to 100% on one thing my overall rating was 60%(based on two different health issues) do I figure the retro based on the increase from 50% to 100% rating increase or figure the retro based on the 60% overall rating that I was being paid at. Don't know if I am making any since or not either way the amount does not match what I received.

I would call the VARO and ask to speak to a supervisor. It doesn't surprise me that the VA has messed up on a mathematics issue. Just look at the way they calculate the %. Dale Jr. 8

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.
