Persistence pays off!  Background:

In 2002, I "was told" by VFW that I should drop my claim.  

In 2004, I "was told" by another VSO that I should "settle" for 0 percent hearing loss and not appeal.  

In 2005, I lost my home waiting on VA to process my benefit claim.  

In 2006, several attorney's told me "I didnt have a case".  

In 2008, I filed a "Special Handling Request" due to mishandled evidence by my VARO.  It was "quietly" denied by my VARO.  

In 2009, I was awarded 100 percent, to 2007.  I appealed the effective date. 

In 2012, I got a remand in part, partial grant, partial denial.  

In 2013, other lawyers told me I had no case.  

In 2013, the VARO said I should be happy with 100 percent or they could reduce me.  

In 2017, I was awarded TDIU, with another 2 years of retro.    My attorney declined to represent me in an appeal, so I asked others.  

I hired an attorney today, after at least 5 attorney's told me no, that I had no case THIS week.  

Im gonna win this earlier date..I "feel it"

Persistence pays off when all else fails.

I Always let veterans know  not to ever give up  eventually you will win

if broncovet wins his case ?    this is a good example of PERSISTENCE.

but be aware even the best attorney's are fooled into the Wicked ways of the VA.

It's laughable how many CUEs I have had on my claims. After 9 years, 6 after my form 9, I get 100% T&P, they only give me 4 months back for 100% Effective Date. Looking evidence considered, they only looked at VAHS medical records from 2013 on, when I have 20% and 40% hypertension blood pressures going back to 1998 in my VAHS records. Observation notes (doctors notes in your records) note diminished kidney function going back to the same time period, and they only upped my renal to 80% in May 2017. Never give up, NEVER SURRENDER!!!  google site:va.gov lead exposure san diego may 1983 july 1990 first 2 are mine 1554170 and 1422689. They still haven't SC me for lead, gout, sleep apnea, tinnitus or GERD. I want that $142,000 back pay they screwed me out of.

Great news bud, and you keep it going. I have a quick question, I have been 100% P&T since last year. I see that you were 100%, and then applied for TDIU, is there any benefit to that? Also, I had an FDC that I filed for an increase in my back around August 2017. The C&P examiner granted Nerve damage for the left leg as I was going to have back surgery in September 2017. So I turned around and opened a new FDC September the 20th, as I was not going to accept the 20% I currently have for my lower back, as I had L3/L4/L5 surgery, with severe nerve damage to my left leg. The surgery actually did not work and I need a fusion up to my neck. So my reopened claim finished yesterday and it states under disabilities, Lumbar Back Strain 20%(Claimed as Temporary Total Disability).  I didnt see an update in the %, or my pay, as this would qualify me for SMC S, as I have my bladder condition currently granted at 60%. What is your opinion on this? Thanks in advance

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
