They had no Voc evidence

Question

So they deny me and say they don’t have vocational evidence for a grant but they can opinion to deny based on not even the doctors opinion they sent me too but DDS adjucator. They requested a Voc expert for the hearing and as such I had an assessment done by another Voc expert to see his opinion which was a grant. I used Mylar Disability and am worried about not having a hired attorney yet for my claim. Stress is besting me again much my VA claim until I was found P and T. My judge approval rating is 70% in all his cases this year but just don’t want myself to get complacent so I don’t forget details. Is there anything else I could possibly get to help my SSDI case other then the mental RFC my primary VA doctor filled out and the Voc assessment I had done?

That SSI Denial Letter is quite comprehensive and appears to cover the Denial Decision.

Don't mess around, get the SSI Attorney. For $1500+ he or she will write up the Legal Brief and accompany you to the SSI Appeal Hearing. The "Free Consult" will determine how strong your case is and determine if the Legal Fees will be deducted from the Award.

I completely agree with Gastone, I had an attorney at my ALJ hearing.  There will be a person there who specializes in vocational employment with various disabilities and the judge will go through each of your disabilities and ask if there is ANY job you could perform, and they do mean ANY, my attorney was paramount in my success. He knew exactly what questions to ask me, as my disabilities are invisible.  SS never sent me to any ss doctors only used my VA records which were extensive but ultimately awarded me AT the hearing full favorable with a date of disability so far back that I was given the maximum period of backpay.  I never would have been successful without my attorney, he knew which little things to bring up in my mental health records, the physical issues as well that I would not have been able to articulate nearly as well and may have come across as a bit of a liar but him, pulling them out of my mh notes as bringing up situations that clearly were upsetting to me, which he never discussed doing prior to us going in was definitely a huge deal.  He didn't blind side me or talk about my ptsd trigger sort of stuff but things that keep me from functioning often in normal work place settings.  My physical disabilities weren't as hard to explain but again, when the judge questioned the employment specialist about me even having the ability to say clean houses alone, of course I wouldn't be able to do that or do medical coding at home because of my severe chronic migraines and shoulder issues, they literally go over any single job that you could possibly do, even a crappy one.  An attorney is worth the maximum they can take from you, truly.  You are very close to the end, I have kept you in my thoughts and prayers as I know this has been weighing heavily on you.  Know you are not alone.

I agree with the others on this issue  however if you been in Voc Rehab and the counselor can't find you any type job due to your s.c. disability  then a letter is good that he sates this.

this veteran is not re-trainable due to his/her s.c. disability and can not perform the job he was trained to do  due to his  s.c. disability.

also if you were trained to do a certain job and you can't do that anymore then he needs to state this too.

Heads up.. has anyone ever requested there file from SSA for example like from a DDS decision.. man.. Wow.. it shows everything.. i mean everything like Doctors emailing the examiner back and forth with call log data/ employee/Doctor ID badge number date and time stamp everything. Its Shows that Longitudinal evidence or information. If a claimant really wan't to know what goes behind the curtain on your claim i would suggest you request for the Statement of Claimant ****Jfrei***** request for it to be put on a CD/DVD.. you need the code they will provide to unlock your file on that DVD/CD and once you open the file .. you can cut and paste the files you want and email them to {yourself] or of your choosing. It really helps with the closure and gives you an idea of the why whether its hogwash or not. You got to get on SSAzz to get the CD.. don't sleep on them.. they will prolong a request as much as the person who is in charge of data file creating pleases too... Good luck..

 

Obtw.. that "we don't have any vocational information" appears to be a standard eye poke!.. i have seen this many times on my claims.... ugh.. makes me cringe.
