BVA 2018 decisions on line- Nehmer

There are 48 new 2018 deisions regarding Nehmer- this one is Very interesting:

The veterans claimed HBP due to his PTSD and also due to his AO DMII.

What is interesting is that BVA included the "limited, suggestive association of AO to HBP and remanded the claim---as that could potentially become an AO presumptive, and maybe now- but the examiner must render a decision on what the veteran's HBP is from.

In addition, the Veteran's exposure to herbicides during his service has been conceded.  While hypertension is not listed on the exclusive 

list of presumptive diseases due to herbicide exposure under 38 C.F.R. § 3.309(e), the NAS IOM's Veterans and Agent Orange: Update 2010 concluded that there was "limited or suggestive" evidence of an association between herbicide exposure and hypertension.  See Nat'l Acad. of Sci., Inst. of Med., Veterans & Agent Orange: Update 2010 at 694.  Therefore, on remand, a medical opinion should be obtained determining whether the Veteran's hypertension stems from his presumed exposure to herbicides.
