Question

Will post my appeal journey in this thread. Here starts the road to victory. 

Sept 2017 - hired GloverLuck since I HADIT with getting denied by the VA with the injuries I have documented in my file. I was homeless, lost my marriage, and 15 years of my life.

April 2018 - Got my Docket #.

Hopefully it does not take 5 years, but I expect it for the traditional route, and not RAMP.

My first thoughts are that he is gouging.  But, if a doctor does not know how to write a VA approved nexus you will fail unless the BVA gets involved.  My specialist did not write a true nexus letter but I believe it was accepted by the BVA because it noted my in service injury, how it can cause my condition, that I had no other triggers and then he cited current medical literature.  An IMO nexus letter can be no good at the RO level if it has not got the correct statements.  It is sad that they will only accept a letter with the correct accepted statement but it is how they roll.

We have the full criteria for an IMO/IME in that specific forum.

The articles there I wrote were based on 2 exempliary IM0s I got from Dr Bash. He had worked for the VA long ago and knows exactly what an IMO/IME should contain.

The IMO/IME doctor should have a copy of any negative C & P exam to fully address it and provide a solid medical rationale for why the C & P exam is wrong.

They will need a complete copy of your medical records, and in many types of claims, a complete copy of your SMRs.

Yes I have my c-file on the cd and made copies of it. As well as writing my own medical opinions with extensive medical publications/journals/research/papers rational. Which means nothing unless a MD agrees with it and signs off on it.

I read a lot of your post Berta and aware of the IMOs you did with Dr. Bash years ago.

That's the problem most regular doctors don't want to deal with this red tape (DBQ, opinons, etc) by the VA because the bottom line is that they're simply doctors and not legal-medical doctors for that is completely different training.  So far I asked all of my private doctors and they said no. They just want to be MDs and not worry about the rest. For example I just left one of my specialist physican, who I have been seeing for almost three years, and asked him to do an opinion for me. He looked over the DBQ and said this is complex and does not want to do it.
