CUE moving forward?

Good afternoon,

I had a call to schedule a C&P for my shoulder from LHI this morning.  Generality speaking does that mean they agreed with my rationale for a CUE and are moving forward with the claim?

It depends on what the CUE was for-

can you scan and attach a copy of  the UE claim here?  (Ciover Cfile # and name prior to scanning it)

A CUE that involves the wrong diagnostic code, to your detriment, if you already have a SC rating for it, could fly and garner a C & P but did you raise CUE

or send them a letter to reconsider under 38 CFR 3.156 (meaning they might have missed something in your SMRs or on your discharge physical......

CUE rests on medical evidence in VA's possession at time of the alledged CUE decision.

'In VA's possession 'means anywhere in the VA system , and to include your SMRs.

I could look on my old claim again.  But was denied on basis that there was no shoulder injury in my STR. I found a copy of my final physical where it showed in for different sections that I was being treated for my shoulder. I have the final physical to my VSO and he wrote down some of my compliant and said he would file a CUE.  I haven't heard anything since then, until I was called to schedule a C&P for it this morning.

I think it might be a very good thing that you are set for the C & P exam!

Sounds like your VSO is really on the ball!
